A BILL TO BE ENTITLED AN ACT

Relating to Etowah County; to authorize the Etowah County Commission to impose an administrative late payment penalty on county ad valorem taxes; and to provide for the distribution of the revenue.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. This act shall apply only in Etowah County.

Section 2.

(a) In addition to any penalty imposed by law for the late payment of ad valorem taxes in Etowah County, the Etowah County Commission, by ordinance, may impose an additional administrative late payment penalty in the amount not to exceed two dollars ($2) per day not to exceed a total of three hundred dollars ($300) on that portion of ad valorem taxes due to the county as prescribed on each bill of assessment distributed to property owners in the county. The additional administrative late payment penalty imposed for late payment of the county portion of any ad valorem taxes due shall be administered and collected in the same manner as now prescribed by law for any existing delinquent payment penalties on taxes including the placement of liens on properties on which payment of the taxes may be delinquent. It is the express intent of this section that the additional administrative late payment penalty shall apply only to the county portion of any ad valorem taxes due and payable as provided by law and that the additional administrative late payment penalty shall not be applicable to any state or other local ad valorem taxes due and payable as provided by law.

(b) The proceeds of the additional administrative late payment penalty on the county ad valorem taxes imposed by this section shall be distributed as follows: 12.5 percent to the Etowah County Revenue Commissioner’s Special Fund for the payment of reasonable and necessary expenses incurred in carrying out the official duties of the office of the revenue commissioner; 40 percent to the Etowah County Commission to be used only for the advancement, development, and promotion of the Little Canoe Creek Megasite for a period of 12 years except as otherwise provided in this section. After a period of 12 years, or after the Little Canoe Creek Megasite is sold, leased, or is otherwise under a state project agreement, the Etowah County Commission, by majority vote, may use this revenue towards other projects related to industrial recruitment and economic development; and Etowah County Commission to be used only for the maintenance, improvement, replacement, and construction of roads and bridges in the county.

Section 3. The provisions of this act shall be supplemental and cumulative to any and all other laws or parts of laws relating to the authority of Etowah County.

Section 4. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.

NOTICE OF PROPOSED RENEWAL OF AN INDUSTRIAL WASTE LANDFILL PERMIT UNDER THE ALABAMA SOLID WASTES AND RECYCLABLE MATERIALS MANAGEMENT ACT AND REQUEST FOR COMMENTS

Etowah County

Alabama Power Company has applied for a permit to continue to operate an industrial waste landfill known as the Gadsden Steam Plant Landfill (Permit 28-05).  The waste stream for the Gadsden Steam Plant Landfill would remain non-hazardous construction and demolition waste such as waste building materials, masonry, wall board, roofing material, wood products, pipe, insulation and similar materials, rubbish such as paper products, cartons, cardboard, pallets, scrap metal, tires and furniture; asbestos containing material; and non-hazardous industrial wastes such as anion/cation resins and non-hazardous sandblast waste.  The service area for the Gadsden Steam Plant Landfill would remain the Gadsden Steam Plant located in Gadsden, Alabama.  The maximum average daily volume of waste disposed at the Gadsden Steam Plant Landfill would remain 5 cubic yards per day. All previous variances have been requested and shall be approved by the department.

The Gadsden Steam Plant Landfill is described as being located in the South ½, Sections 2 and 11, Township 12 South, Range 6 East in Etowah County, Alabama.  The Gadsden Steam Plant Landfill consists of 3.44 acres with all for disposal operations.

Copies of the public notice and proposed permit are available for public inspection electronically via the ADEM web site at http://adem.alabama.gov/newsEvents/pubHearings.cnt and the complete application at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing or by email, to the Department’s named contact above within 35 days following the publication date of this notice.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 35-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing upon receipt of a significant number of technical requests.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Solid Wastes and Recyclable Materials Management Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
