Whereas, the City of Gadsden owns the following described property pursuant to warranty deeds dated November 16, 1928, September 12, 1945, and March 20, 2018;

Lot 6 and a portion of Lot 7 in Block 7 in W. T. Cox’s South Addition, as more particularly described in those certain deeds as follows: a) Deed from W. T. Cox and Maud L. Cox to the City of Gadsden dated November 16, 1928; and b) Deed from Al Cooper and wife, Jettie Merle Cooper, to the City of Gadsden dated September 12, 1945. ORDINANCE NO. O-06-19

Amending City Code §34-7 Regarding Qualifying Fee for Candidates

Whereas, pursuant to Act No. 2018-565, a referendum election was held on January 22, 2019, regarding whether the city board of education should be appointed or elected, and a majority of qualified electors voted in favor of an elected board; and

Whereas, a subsequent election will be held as soon as practicable for members of the city board of education to be elected and the council wishes to set a qualification fee that is consistent with the amount for candidates in all other city elections;

Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, that Section 34-7 of the City Code is amended to read as follows:

Sec. 34-7. Qualification fee for candidates.

(a)          A qualification fee in the amount of $50.00 is hereby fixed and imposed upon all candidates seeking election as mayor of the city, except as provided in (e).

(b)          A qualification fee in the amount of $50.00 is hereby fixed and imposed upon all candidates seeking election as council member of the city, except as provided in (e).

(c)          A qualification fee in the amount of $50.00 is hereby fixed and imposed upon all candidates seeking election as member of the city board of education, except as provided in (e).

(d)          The qualification fee shall be paid to the city clerk and deposited in the general fund of the city at or prior to the time of a candidate submitting qualification papers to the clerk.

(e)          Any person desiring to qualify who is not financially able to pay the required fee may qualify as a candidate by furnishing the city clerk with verified statements from three city electors stating that the person is indigent and not financially capable of paying the required fee fixed by this ordinance.

(f)           This ordinance is adopted pursuant to Section 11-46-2 of the Alabama Code of 1975 and shall be effective in all elections, both general and special, for the stated offices from and after the date of adoption.
