The City of Gadsden will solicit comments on its 2023 Consolidated Annual Performance & Evaluation Report at a Public Hearing held at 10:00A.M. on Wednesday, August 14, 2024 at the City of Gadsden, 90 Broad Street, Gadsden, AL 35901. This Notice will commence the City’s 15-day public comment period beginning on Wednesday, August 7, 2024 and ending on Friday, August 23, 2024.  

The City is required by the U.S. Department of Housing and Urban Development (HUD) to annually submit a Consolidated Annual Performance and Evaluation Report (CAPER).  This report provides an assessment of the City’s progress in carrying out its five-year strategic plan and its one-year action plan for the Community Development Block Grant Program (CDBG). The purpose of this notice is to make the CAPER report available to the public for comments prior to its submittal to HUD. 

Draft copies of the 2023 Consolidated Annual Performance & Evaluation Report will be available for examination and comment by the public during the virtual public hearing scheduled Wednesday, August 14, 2024 at 10:00A.M. The required public review ends Friday, August 23, 2024. The City will receive written comments until 5:00 P.M. on Friday, August 23, 2024.  

No displacement will occur as a result of the activities described herein. Should displacement occur, the City of Gadsden implements the provisions as required by CFR 570.606 (Residential Anti-Displacement and Relocation Assistance). Amending City Code Section 58-8(b)(1)

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Section 58-8(b)(1) of the Code of Ordinances of the City of Gadsden is amended to read as follows:

(1) Each board shall be composed of five members, with the exception of the Turrentine Avenue Architectural Review Board, which shall consist of seven members. Board members shall have demonstrated training or experience in the field of history, architecture, architectural history, urban planning, archaeology or law. All of the members of each board shall be residents of the historic district to which such board is applicable. No member of the city council or the mayor shall serve as a member of any such board. A member of any such board may also be a member of the commission. Members of each board shall be nominated by the mayor and appointed by the city council. Except for the original members of each board, members of each board shall serve three-year terms and shall be appointed in such manner as to serve overlapping terms. Two of the original members of each board shall be appointed to serve one-year terms and the remainder of the original members of each board shall be appointed to serve three-year terms. A member shall serve after the expiration of his term until his successor is elected. Members of each board may be reappointed. Nomination and appointment of members of each board shall be made so that each board will be composed of persons with as much of the training and experience specified in this section as possible.

Section 2. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.  

Section 3. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 4.  This ordinance shall become effective upon publication.

$600,000 will be used, in addition to previously budgeted funds of $416,000, to pay for the refund petition filed by Prime Healthcare Services d/b/a Riverview Regional Medical Center. The total payment for this refund petition is approximately $1,016,000. 

$262,500 will be used to pay for settlement costs related to Blom, et. Al v. City of Gadsden, et al, Case No. CV-22-582.
