ORDINANCE NO. O-29-25

Amending City Code Section 106-86

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Section 106-86 of the Code of Ordinances of the City of Gadsden is amended to add paragraph (C) which will read as follows:

Sec. 106-86. Residential collection fee.

(a) Monthly fee. The fee for weekly residential garbage collection shall be $20.00 per month for each residence unit, which may be billed quarterly. 

(b) Fee for second container. If a second container is necessary, the fee shall be doubled. 

(c) Damaged container. Any damaged or defaced container shall be replaced at a cost of $58.00 plus a $25.00 delivery return fee. 

(d) Responsibility for payment. The owner of the property shall be liable for payment if the fee is not paid by the occupant of the property. 

(e) Due date for payment; delinquency. Payment shall be due upon receipt and shall be delinquent if not paid in 30 days. There shall be a penalty of $5.00 per can per quarter for any payment after the delinquent date. It shall be unlawful to fail to pay a bill that is delinquent. A citation for failure to pay may be issued in substantially the form provided in section 82-31. Violations shall be punished by a fine of not less than $50.00, nor more than $200.00. If the violation is a continuing one, each day’s violation shall constitute a separate offense and shall be punished accordingly. 

(f) Vacant residences. The fee shall be billed to every non-exempt residential unit, even if vacant, unless water service has been disconnected. Payment shall be due if a can is placed at the household for one day in the month. The household may request that the department of public works remove the can if it is to be vacated. If the household is vacant more than three months, the can shall be removed and no payment shall be due until a request is made to place a can there to obtain collection service from the city. 

(g) Use of fees. The funds may be used to pay landfill tipping fees; to close the present municipal landfill; to acquire, design and construct any solid waste transfer station; to assist in the acquisition, design and construction of a new sanitary landfill in compliance with federal environmental regulations; to purchase equipment and supplies used in the collection of garbage; and for other uses approved by the city council. 

(h) Voluntary contributions to Gadsden City Board of Education. A non-mandatory contribution of $1.00 per quarter shall be added to each quarterly bill for each residence unit designated for school safety and the security of facilities and programs of the Gadsden City Board of Education. This program shall be known as the “School Safety” fund. So long as sufficient funds exist from voluntary contributions as certified by the city’s finance director, a request made by the superintendent of Gadsden City Schools for school safety or security is authorized to be approved by the mayor. Any other requests made by the superintendent must first be approved by the city council upon recommendation by the mayor and certification of sufficient funds by the finance director. Each bill-payer shall have the right to opt out of the non-mandatory $1.00 contribution upon payment remittance of each quarterly bill. 

Section 3. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.  

Section 4. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 5. This ordinance shall become effective upon publication.

Sealed construction proposals will be received by the City Clerk, City of Gadsden, Alabama, at the City Hall, 90 Broad Street, Room 411, Gadsden, Alabama until 2:00 P.M., Tuesday, December 16, 2025, for furnishing all labor, materials, equipment, and service required to complete the 2026 City of Gadsden Landscape Maintenance Contract, Bid Request No. 3617, located in the City of Gadsden, Alabama.  

Bids submitted prior to the bid opening by mail shall be directed to “City Clerk, P.O. Box 267, Gadsden, Alabama 35902-0267” or in person delivered to the office of the City Clerk, Room 401, City Hall, 90 Broad Street, Gadsden, Alabama.

Bids will be publicly opened and read at the above time and place. Specifications, and Contract Documents are open to the public for inspection at the City Hall. Electronic (pdf) Specifications, and Contract Documents may be obtained from the City of Gadsden Engineering Department, Room 302, City Hall, 90 Broad Street, Gadsden, Alabama (phone: (256)-549-4520), immediately for free. All bidders must be registered with the City of Gadsden Engineering Department in order to submit a bid. Bids received from unregistered bidders will be rejected.

The bidder shall file with his bid either a cashier’s check drawn on an Alabama bank, payable to the City of Gadsden, Alabama, or a bid bond executed by a surety company duly authorized and qualified to make such bonds in Alabama, in an amount equal to the lesser of five percent (5%) of the bid or ten thousand ($10,000).

The successful bidder will be required to furnish and pay for the satisfactory Performance and Payment Bond or Bonds in the amount required by Section 39-1-1(a), Code of Alabama 1975, and evidence of insurance as required by the bid documents within ten (10) days after being notified that he has been awarded the contract.

No bidder may withdraw his bid within six (60) days after the actual date of the opening thereof.  The bidder must comply with all requirements of the public works bid law Section 39-2-1 et seq., Code of Alabama 1975.

The Owner reserves the right to reject any or all bids and to waive any informalities and to award the contract to the lowest, responsible, responsive bidder. All bidders must comply with requirements of the Contractor’s Licensing Law of the State of Alabama and be certified for the type work on which the proposal is submitted.

Any bidder, whether a resident or non-resident of the State of Alabama, must comply with all applicable provisions of Section 34-8-1, et. seq., Code of Alabama, 1975, including requirements for licensing as a general contractor and the necessity to show evidence of license, with a specialty in landscaping, before the bid will be considered by the awarding authority.  A current license number must be included on the bid. Contractor must also have on staff an employee(s) with an undergraduate degree in Landscape Horticulture and Agronomy. Proof shall be submitted prior to award.  

This is a tax-exempt contract.

By signing this contract, the contracting parties affirm, for the duration of the agreement, that they will not violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the state of Alabama. Furthermore, a contracting party found to be in violation of this provision shall be deemed in breach of the agreement and shall be responsible for all damages resulting therefrom.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on a basis of race creed, color, sex, or national origin.  Bidders must also certify they will make facilities handicap accessible to the extent required by law.
