ORDINANCE NO. O-32-19

Ordinance Amending Section 2-5, Council Member Travel Expenditures

in the Code of Ordinances of the City of Gadsden

WHEREAS, Ordinance Number O-47-09 was adopted on December 14, 2009 and permitted the use of discretionary funds for travel expenditures and training purposes if the council member had exceeded his or her appropriation for such; and

WHEREAS, this Ordinance conflicts with Section 2-343(g) of the Code of Ordinances, wherein it specifically states that discretionary funds cannot be used for the purposes of travel or training of the council member.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1.                                     Section 2-5 (O-47-09) of the Code of Ordinances, is amended as follows:

Sec. 2-5.         Limitation on council member travel expenditures.

Each council member shall be limited to incurring expenditures for travel, training and conference purposes no more than one-seventh of the total appropriation for that purpose in the annual budget. A council member may transfer his or her funds or a portion thereof to another member’s travel expenditure fund.

Section 2.       A violation of this ordinance shall be punished as provided in Section 1-8 of the Gadsden City Code.

Section 3.             The provisions of this ordinance shall be effective on publication.

Section 4.             The sections, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable. If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance. The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.

Section 5.             The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.
