NOTICE OF MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the indebtedness secured by thatcertain Mortgage executed by Melissa H. Yates, an unmarried woman, to Mortgage Electronic

Registration Systems, Inc. (“MERS”), (solely as nominee for Lender, First Federal Bank,

and Lender’s successors and assigns), dated the 20th day of January, 2011, which

Mortgage was recorded in the Office of the Judge of Probate of Etowah County, Alabama,

in Instrument Number 3344445; said Mortgage having been transferred and assigned by

Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for

Lender, First Federal Bank, and Lender’s successors and assigns) to Alabama Housing

Finance Authority by virtue of that certain Assignment of Mortgage dated April 28, 2021

and recorded in said Probate Office in Instrument Number 3520002; said Mortgage having

been transferred and assigned by Mortgage Electronic Registration Systems, Inc.

(“MERS”), (solely as nominee for Lender, First Federal Bank, and Lender’s successors

and assigns) to Alabama Housing Finance Authority by virtue of that certain Corrective

Assignment of Mortgage dated April 28, 2021 and recorded in said Probate Office in

Instrument Number 3548474; said Mortgage having been transferred and assigned by

Mortgage Electronic Registration Systems, Inc. (“MERS”), (solely as nominee for

Lender, First Federal Bank, and Lender’s successors and assigns) to Alabama Housing

Finance Authority by virtue of that certain Corrective Assignment of Mortgage dated

October 24, 2022 and recorded in said Probate Office in Instrument Number 3548490; said

mortgage being modified by virtue of that certain FHA Covid-19 Advance Loan Modification

Agreement dated October 29, 2021 and recorded in said Probate Office in Instrument Number

3530423. The undersigned Alabama Housing Finance Authority as Assignee of said Mortgage

will, under and by virtue of the power of sale contained in said Mortgage, sell at auction to the

highest bidder for cash before the main entrance of the Etowah County Courthouse in the City of Gadsden, Alabama, during the legal hours of sale on March 30, 2023, the real property described in said Mortgage, which said description is hereby referred to and made a part hereof, said property being situated in Etowah County, Alabama, to-wit:

NOTICE is hereby given that a bill substantially as follows will be introduced in the 2023 Regular Session of the Legislature of Alabama and application for its passage and enactment will be made:

A BILL TO BE ENTITLED AN ACT

Relating to Etowah County; to provide that the director and employees of The Etowah County Punishment and Corrections Authority have arrest powers and may make arrests 12

in certain circumstances.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) The Director of The Etowah County Punishment and Corrections Authority and employees of the authority shall be considered law enforcement officers of this state with power to make arrests and serve arrest and search warrants while performing their official duties to the same extent as deputy sheriffs are authorized in their counties as

long as they hold current certification from the Alabama Peace Officers’ Standards and Training Commission. The powers of arrest under this section shall be limited to investigations and arrests of criminal acts committed at the authority’s program facilities and acts committed by persons under the authority’s supervision that are a violation of supervision or are a criminal offense.

(b) The authority director or corrections employee with law enforcement authority may arrest any person under his or her supervision without a warrant if he or she has probable cause to believe the person has committed a criminal offense or violated the conditions of supervision. In case of a warrantless arrest, the director or employee shall prepare a written warrant stating that the offender, in his or her judgment, has committed a criminal offense or violated a condition of supervision, and the warrant shall suffice to immediately bring the offender before the court to determine probable cause for the act described in the warrant. The court may order detention of the offender pending further hearing, after which the court may revoke probation or participation in the authority’s community corrections program, or both, pursuant to subdivision (d)(3) of Section 15-18-175, Code of Alabama 1975. 

(c) The director and employees of the authority given powers of arrest by this section shall be required to comply with the minimum standards for state law enforcement officers as certified by the Alabama Peace Officers’ Standards and Training Commission.   

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.

This Project shall be bid EXCLUDING SALES AND USE TAXES, per the Alabama Department of Revenue  (ADOR), Act 2013-205; Section 40-9-14.1 Code of Alabama 1975. Both tax exempt entity (The City of  Attalla) and the Contractor shall apply for certificates of exemption. ADOR shall issue certificates of  exemption from sales and use tax for each tax exempt project. Certificates shall only be issued to  Contractors licensed by the State Licensing Board for General Contractors or any Subcontractor working under  the same Contract. Items eligible for exemption are building materials, construction materials and supplies and  other tangibles that become part of the structure. ADOR will handle the administration of the certificates and the  accounting of exempt purchases.

Bids shall be submitted on the Proposal Form bound in the Project Manual, or copies thereof. All bidders  bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be  licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license  before bidding or bid will not be received or considered by the Architect. This provision applies whether bidder  is a resident or non-resident of the State of Alabama. The bidder shall show such evidence by clearly displaying  his or her current license number on the outside of the sealed envelope in which the proposal is delivered. A cashier’s check drawn on an Alabama bank, payable to the City of Gadsden, Alabama, or a bid bond executed by a surety company duly authorized and qualified to make such bonds in Alabama, in an amount equal to the lessor of five percent (5%) of the bid or ten thousand dollars ($10,000), shall be submitted with each bid.

The Owner reserves the right to waive any informalities or to reject any and all bids.

Any bidder, whether a resident or non-resident of the State of Alabama, must comply with all applicable provisions of Section 34-8-1, et.seq., Code of Alabama, 1975, including requirements for licensing as a general contractor and the necessity to show evidence of license, before the bid will be considered by the awarding authority.  A current license number must be included on the bid.

Bidders must comply with the President’s Nos. 11246 and 11375 which prohibit discrimination in employment regarding race, creed, color, sex, or national origin.  Bidders must also comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, Title VIII of the Civil Rights Act of 1968, and Section III of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170lu.

By signing this contract, the contracting parties affirm, for the duration of the agreement, that they will not violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the state of Alabama.  Furthermore, a contracting party found to be in violation of this provision shall be deemed in breach of the agreement and shall be responsible for all damages resulting therefrom.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on a basis of race, creed, color, sex, or national origin.  Bidders must also certify they will make facilities handicap accessible to the extent required by law.

Sealed bids for the Northeast Alabama Regional Megasite 500,000 Gallon Elevated Water Tank I Project will be received at the Etowah County Commission Chambers (Room 108), located on the First Floor of the Courthouse, 800 Forrest Avenue, Gadsden, AL 35901 until Tuesday, April 4, 2023 at 2:00 P.M. local time at which time the Bids received will be publicly opened and read.

The Project includes the following Work:  Construction of a new 500,000 gallon multi-column elevated potable water storage tank with site improvements with an additive alternate of a 1,000,000 gallon multi-column elevated potable water storage tank and related appurtenances.
