Bids will be publicly opened and read at the above time and place. Specifications, and Contract Documents are open to the public for inspection at the City Hall. Electronic (pdf) Specifications, and Contract Documents may be obtained from the City of Gadsden Engineering Department, Room 301, City Hall, 90 Broad Street, Gadsden, Alabama (phone: (256)-549-4520), immediately for free. All bidders must be registered with the City of Gadsden Engineering Department in order to submit a bid. Bids received from unregistered bidders will be rejected.
The bidder shall file with his bid either a cashier’s check drawn on an Alabama bank, payable to the City of Gadsden, Alabama, or a bid bond executed by a surety company duly authorized and qualified to make such bonds in Alabama, in an amount equal to the lesser of five percent (5%) of the bid or ten thousand ($10,000).
The successful bidder will be required to furnish and pay for the satisfactory Performance and Payment Bond or Bonds in the amount required by Section 39-1-1(a), Code of Alabama 1975, and evidence of insurance as required by the bid documents within ten (10) days after being notified that he has been awarded the contract.
No bidder may withdraw his bid within six (60) days after the actual date of the opening thereof. The bidder must comply with all requirements of the public works bid law Section 39-2-1 et seq., Code of Alabama 1975.
The Owner reserves the right to reject any or all bids and to waive any informalities and to award the contract to the lowest, responsible, responsive bidder. All bidders must comply with requirements of the Contractor’s Licensing Law of the State of Alabama and be certified for the type work on which the proposal is submitted.
Any bidder, whether a resident or non-resident of the State of Alabama, must comply with all applicable provisions of Section 34-8-1, et. seq., Code of Alabama, 1975, including requirements for licensing as a general contractor and the necessity to show evidence of license, before the bid will be considered by the awarding authority. A current license number must be included on the bid.
Bidders must comply with the President’s Nos. 11246 and 11375 which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must also comply with Title IV of the Civil Rights Act of 1964, Title VIII of the Civil Rights Act of1968, and Section III of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170lu.
By signing this contract, the contracting parties affirm, for the duration of the agreement, that they will not violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the state of Alabama. Furthermore, a contracting party found to be in violation of this provision shall be deemed in breach of the agreement and shall be responsible for all damages resulting therefrom.
Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on a basis of race creed, color, sex, or national origin. Bidders must also certify they will make facilities handicap accessible to the extent required by law.

REQUEST FOR RELEASE OF FUNDS
On or about 9-1-22 the Grant Recipient will submit a request to the Alabama Department of Economic and Community Affairs (ADECA) for the release of CDBG funds under Title I of the Housing and Community Development Act of 1974, as amended (PL 93-383), to undertake a project known as Demolition of Elliott Community Center for the purpose of demolition of the property located at 2829 West Meighan Boulevard (Elliott Community Center) using $400,000 in ADECA CDBG-CV funds.
FINDING OF NO SIGNIFICANT IMPACT
The Grant Recipient has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Gadsden Community Development Department, 90 Broad Street, Room 310, Gadsden, AL and may be examined or copied weekdays 8:30 AM to 4:00 PM.
PUBLIC COMMENTS
Any individual, group or agency may submit written comments on the ERR to the City of Gadsden Community Development Department. All comments received by July 18, 2022 will be considered by the Grant Recipient prior to authorizing submission of a Request for Release of Funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The Grant Recipient certifies to ADECA that Renee’ Baker in their capacity as the Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. ADECA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Grant Recipient to use Program Funds.
OBJECTIONS TO RELEASE OF FUNDS
ADECA will accept objections to its release of funds and the Grant Recipient certification for a period of 15-days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or the Grant Recipient; (b) the Grant Recipient has omitted a step or failed to make a decision or funding required by HUD regulations at 24 CFR part 58; (c) the Grant Recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR part 58 before approval of a Release of Funds by ADECA; or (d) another Federal agency acting pursuant to 40 CFR part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
