Default having been made of the terms of the loan documents secured by that certain mortgage executed by Keith Pitman Toney A Married Man And Rita Lynn Toney to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for USAA Federal Savings Bank, its successors and assigns dated February 26, 2010; said mortgage being recorded on March 2, 2010, as Instrument No. 3328332 in the Office of the Judge of Probate of Etowah County, Alabama. ORDINANCE NO. O-02-22   

Adopting 2021 edition of the International Fire Code, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from condition hazardous to life or property in the occupancy of buildings and premises; providing for the issuance of permits and collection of fees therefore; amending Sections 50-61 and 50-62 and repealing all other ordinances and parts of ordinances in conflict therewith

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1.  Section 50-61 of the City Code is amended to read as follows:

Sec. 50-61.  International Fire Code adopted.

A certain document, three copies of which are on file in the office of the City Clerk, being marked and designated as the International Fire Code, 2021 edition, including Appendix Chapters B (Fire-Flow Requirements for Buildings), C (Fire Hydrant Locations and Distribution), D (Fire Apparatus Access Roads), E (Hazard Categories), F (Hazard Ranking) and G (Cryogenic Fluids—Weight and Volume Equivalents), Appendix H (Hazardous Materials Management Plan and Hazardous Materials Inventory Statement), Appendix I (Fire Protection Systems—Unsafe Locations), Appendix J (Building Information Sign), Appendix M (High-Rise Buildings – Retroactive Automatic Sprinkler Requirement), and Appendix N (Indoor Trade Shows and Exhibitions) as published by the International Code Council, is adopted as the fire code of the city, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises in the city; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said fire code on file in the office of the city clerk are referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in Section 2 of this ordinance.

Section 2.  Section 50-62 of the City Code is amended to add the following:

Section 1103.5.3 Group I-2, Condition 2. In addition to the requirements of Section 1103.5.2, existing buildings of Group I-2, Condition 2 occupancy shall be equipped throughout with an approved automatic sprinkler system in accordance with Section 903.3.1.1. The automatic sprinkler system shall be installed by January 1, 2029.

Section 5. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 6.  If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this ordinance.  The City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, regardless of the fact that any one or more sections, subsections, sentences, clauses and phrases were declared unconstitutional or invalid.

Section 7.  Nothing in this ordinance or in the fire code hereby adopted shall be construed to affect any suit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.

Section 8.  The City Clerk is hereby ordered and directed to cause this ordinance to be published. 

Section 9.  This ordinance and the rules, regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect and be in full force and effect from and after the first day of the first month following its publication.
