Default having been made in the indebtedness secured by that certain mortgage executed by Helen V Mccartney Unmarried to Network Funding, LP dated August 24, 2010; said mortgage being recorded in Book 3337558, Page 11  in the Office of the Judge of Probate of Etowah County, Alabama.  Said Mortgage was last sold, assigned and transferred to Nationstar Mortgage LLC d/b/a Champion Mortgage Company   in Instrument 3380706 in the Office of the Judge of Probate of Etowah County, Alabama.

The undersigned, Nationstar Mortgage LLC d/b/a Champion Mortgage Company  , under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Etowah County, Alabama during the legal hours of sale (between 11am and 4pm), on the 7th day of January, 2016 the following property, situated in Etowah County, Alabama, to-wit:

Said property will be sold subject to the following items, which may affect the title to said real property: all zoning ordinances; matters which would be disclosed by an accurate survey or inspection of the property; any outstanding taxes, including but not limited to, ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities, which constitute liens upon said property; all restrictive covenants, easements, rights-of-way; the statutory right of redemption pursuant to Alabama law; and any other matters of record superior to said Mortgage.  To the best of the knowledge and belief of the undersigned, the party in possession of the real property is Helen V McCartney or tenant(s).

Department

The Etowah County Commission is accepting resumes for the position of Personnel Director. This is a management position with responsibility for all personnel (HR) functions, also including payroll and benefits management for 325+ employees. The Director will also act as the secretary for the Etowah County Personnel Board and Sheriff Department Personnel Board. This Position reports to the Chief Administrative Officer.

The minimum qualifications are:

A BS Degree in Human Resources or Business Administration with a minimum of 5 years of experience or 10 years of experience in the Personnel (HR) field with 4 or more of those years as a manager of an HR Department with 100 or more employees.

Knowledge of Federal and State Labor Laws.

Resident of Etowah County or acquire residency within 6 months of h ire.

Salary is negotiable.

ENTITLED

AN ACT

State of Alabama

County of Etowah

NOTICE is hereby given that a bill substantially as follows will be introduced in the 2016 Regular Session of the Legislature of Alabama and application for its passage and enactment will be made: 

Relating to the City of Rainbow City in Etowah County; to authorize an election to determine whether alcoholic beverages may be sold or dispensed on Sunday by properly licensed retail licensees serving the general public within the city.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. This act shall apply only to the City of Rainbow City in Etowah County.

Section 2. (a) The voters of the City of Rainbow City may authorize the sale of alcoholic beverages within the municipality of Sunday by an election pursuant to this act, in the following manner:

The governing body of the City of Rainbow City, by resolution, may call an election for the municipality to determine the sentiment of the voters of the municipality residing within the corporate limits, as to whether or not alcoholic beverages can be legally sold or distributed on Sunday within the municipality.

(b) On the ballot to be used for such election, the question shall be in the following form: “Do you favor the legal sale and distribution of alcoholic beverages within this municipality, on Sunday between 1:00 P.M. and 9:30 P.M. and on those Sundays on which occurs New Year’s Eve (December 31), after 1:00 P.M.? Yes_ No_.”

(c) The election shall be held and the officers appointed to hold the election in the manner provided by law for holding other municipal elections, and the returns thereof tabulated and results certified as provided by law for municipal elections. Any Sunday sales election shall be held as provided in this act as a special election or at any subsequent municipal election following the date of the resolution.

(d) Notice of the election shall be given by the governing body of the municipality by publication or by posting the notice at the city hall apprising the voters of the municipality, at least three weeks before the date of the election, that an election shall be held to determine whether alcoholic beverages may be sold in the municipality on Sunday. The cost of the election shall be paid out of the general fund of the municipality. 

(e) Only qualified voters of the municipality may vote in the election. If a majority of the voters voting in the municipal election vote “Yes,” alcoholic beverages can be legally sold or dispensed within the corporate limits of the municipality on Sunday by licenses of the Alcoholic Beverage Control Board of Rainbow City serving the general public in accordance with the applicable laws and regulations between the hours of 1:00 P.M. and 9:30 P.M. Except as authorized by law or during such hours, it shall be unlawful for any licensed vendor to sell, dispense, or permit the consumption of alcoholic beverages on Sunday. Provided that those Sundays on which occur New Year’s Eve, December 31, alcoholic beverages may be sold or dispensed by such licensees pursuant to applicable laws and regulation any time after 1:00 P.M. The municipality may enact, by ordinance, such policies it deems appropriate to regulate any aspect or Sunday alcoholic beverage sales.

(f) If a majority of the voters voting in the municipal election vote “No,” alcoholic beverages may not be sold or dispensed in the municipality on Sunday after the hour of 2:00 A.M., except as otherwise authorized by law or by subsequent election which legalizes the sale and dispensing of alcoholic beverages on Sunday.

Section 3. The provisions of this act are cumulative and supplemental to the present power and authority of the City of Rainbow City and is not intended to, nor shall it be interpreted so as to, repeal any existing power or authority of the City of Rainbow City now permitted under the general laws of the state, or under any local or special act of Legislature.

Section 4. This act shall become effective immediately following its passage and approval by the Governor, or its otherwise becoming law.

ATTALLA LAGOON SITE WORK

Sealed Bids for the construction of the ATTALLA LAGOON SITE WORK will be received by the City of Attalla, at their office located at 612 Fourth St., NW, Attalla, AL 35954, until 10:00 A.M. local time on Thursday, February 11, 2016, at which time the Bids received will be publicly opened and read.  The Project consists of lagoon site work including reclamation of existing lagoon with select fill material and surcharging for future treatment facilities.

Bids will be received for a single prime Contract.  Bids shall be on a lump sum basis as indicated in the Bid Form.

The Issuing Office for the Bidding Documents is Goodwyn, Mills & Cawood, Inc., 2660 EastChase Lane, Suite 200, Montgomery, AL 36117, Attn:  Pat Dew (334) 271-3200.  Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00 a.m. – 5:00 p.m. and may obtain copies of the Bidding Documents from the Issuing Office as described below.

Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above, upon payment of a deposit of $100.00 for each set.  Said cost represents the cost of printing, reproduction, handling, and distribution, therefore no refund will be granted.  Checks for Bidding Documents shall be payable to “Goodwyn, Mills & Cawood, Inc.”  Partial sets of Bidding Documents will not be available from the Issuing Office.  Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

Bid security shall be furnished in accordance with the Instructions to Bidders.

The Owner reserves the right to waive any informalities, or to reject any or all bids, and to award the contract to the best and most responsible bidder.  All bidders shall submit, upon request, a list of projects “successfully completed” in the last 2 years, having the same scope of work and approximate construction cost as specified in this project.  All bidders must comply with requirements of the Contractor’s Licensing Law of the State of Alabama and be certified for the type of work on which the proposal is submitted.  Each bidder must deposit with his bid, security in the amount, form and subject to the conditions provided in the Instructions to Bidders.

All Bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Engineer; the Bidder shall show such evidence by clearly displaying the license number on the outside of the envelope in which the Proposal is delivered.

No bidder may withdraw his bid within 60 days after the opening thereof.
