Default having been made of the terms of the loan documents secured by that certain mortgage executed by Patrice K Golden And Michael D Golden Wife And Husband  to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for HOMECOMINGS FINAN-CIAL, LLC (F/K/A HOMECOMINGS FINANCIAL NETWORK, INC., its successors and assigns dated April 13, 2007; said mortgage being recorded on April 23, 2007, as Instrument No. 3269500 in the Office of the Judge of Probate of Etowah County, Alabama. From said point of beginning and along said centerline, N 89 degrees 10 minutes 31 seconds E a distance of 144.18 feet to a point; thence leaving said cen-terline, S 00 degrees 10 minutes 52 seconds E a distance of 606.31 feet (passing through a reference 3/4 inch crimped top pipe found at 24.72 feet) to an iron pin set; thence N 84 degrees 03 minutes 06 seconds W a distance of 233.33 feet to an iron pin set; thence N 04 degrees 21 minutes 55 seconds E a distance of 324.65 feet to an iron pin set; thence S 87 degrees 30 minutes 28 seconds E a distance of 28.91 feet to an iron pin set; thence N 03 degrees 55 minutes 19 seconds E a distance of 253.58 feet to an iron pin set on the Southerly right-of-way (60’) of said Otway Road; thence leaving said right-of-way, continue N 03 degrees 55 minutes 19 seconds E a distance of 29.23 feet to a point on the centerline of said Otway Road; thence along said centerline, N 89 degrees 10 minutes 31 seconds E a distance of 12.98 feet to the point of beginning.

Less and except any easements or right-of-way, and being a portion of the NE 1/4 of Section 13, Township 10 South, Range 5 East of the Huntsville Meridian, Etowah County, Alabama.

Said property is commonly known as 418 Otway Road, Boaz, AL 35956.

Should a conflict arise between the property address and the legal description the legal de-scription will control.

NOTICE OF PUBLIC MEETING ON PROPOSED ECONOMIC DEVELOPMENT AGREEMENT

The City Council of the City of Gadsden will hold a public meeting on January 23, 2024, at 11 a.m., during the regular weekly council meeting, to consider the adoption of a resolution authorizing an economic development agreement with Gadsden Premiere Cinema, LLC, authorized to do business in Alabama, which proposes to renovate/remodel its existing Gadsden Premiere Cinema location located at 1001 Rainbow Drive in Gadsden.  Gadsden Premiere Cinema, LLC proposes to spend approximately $3,400,000.00 in total development costs, and to employ the equivalent of approximately 30 employees (4 full-time and 26 part time) and to maintain that level of employment for the term of the agreement. Gadsden Premiere Cinema, LLC expects the Lux Cine’ at Gadsden Mall to generate annual sales of more than $3,545,000.00. Gadsden Premiere Cinema, LLC has requested financial assistance from the City of Gadsden to make this project feasible.  The City of Gadsden proposes to pay to Gadsden Premiere Cinema, LLC a sum equal to 2% of the City’s 5% sales tax revenue generated from sales for years one through five and a sum equal to 1% of the City’s 5% sales tax revenue generated from sales for years six through ten at Gadsden Premiere Cinema for a period of ten (10) years total, beginning when the business is open to the public and conducting business, or until the total abatement amount paid by the City equals $600,000.00, whichever occurs first.  The City of Gadsden seeks to provide citizens a wider and more diverse selection of entertainment available, to increase employment, and to increase the tax and revenue base of the City.  All interested persons may examine and review the Agreement and Resolution in the office of the City Clerk during normal business hours, before and after the meeting referenced herein.

Scope of Work includes, but is not limited to, construction of a new load-bearing exterior ma-sonry wall structure consisting of, quarter-log siding, manufactured stone veneer, light-gauge metal roof trusses, composition shingle roofing, pre-finished metal gutters, fascia and down-spouts, sectional overhead doors, aluminum storefront entrances and windows, site improve-ments and utilities.  The new facility will house Fire Department facilities consisting of: two Apparatus Bays, FEMA Storm Shelter, Restroom and Shower Areas, Kitchen, Dayroom/Dining Room, Bunk Rooms, Laundry/Decontamination Room, Office and Mechanical/Electrical Room and Police Department Precinct facilities consisting of: Staff/Public area, Staff Toilet, Storage and Mech./Elect. Room.  Interior construction will primarily be metal stud framing, gyp. board, exposed painted CMU, lay-in ceilings, LVT and porcelain tile flooring and casework cabinetry.  Electrical work will consist of IT cabling, power and suspended and lay-in LED fixtures.  HVAC systems will include gas-fired infrared heaters, fresh air ventilation and package unit HVAC with gas-fired heat and electric cooling.

The successful bidder will be required to furnish and pay for the satisfactory Performance and Payment Bond or Bond in the amount required by Section 39-1-1(a), Code of Alabama 1975, and evidence of insurance as required by the bid documents within ten (10) days after being notified that he has been awarded the contract.

Bids must be submitted on proposal forms furnished by the Architect or copies thereof No bidder may withdraw his bid within sixty (60) days after the actual date of the opening thereof.  The bidder must comply with all requirements of the public works bid law Section 39-2-1 et seq., Code of Alabama 1975.

Any bidder, whether a resident or non-resident of the State of Alabama, must comply with all applicable provisions of Section 34-8-1, et .seq., Code of Alabama, 1975, including requirements for licensing as a general contractor and the necessity to show evidence of license, be-fore the bid will be considered by the awarding authority.  A current license number must be included on the bid.

Bidders must comply with the President’s Nos. 11246 and 11375 which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders must also comply with Title IV of the Civil Rights Act of 1964, Title VIII of the Civil Rights Act of1968, and Section III of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170lu.

By signing this contract, the contracting parties affirm, for the duration of the agreement, that they will not violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the state of Alabama. Furthermore, a contracting party found to be in violation of this provision shall be deemed in breach of the agree-ment and shall be responsible for all damages resulting therefrom.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on a basis of race creed, color, sex, or national origin.  Bidders must also certify they will make facilities handicap accessible to the extent required by law.

Amending City Code 18 – BUILDINGS AND BUILDING REGULATIONS

ARTICLE II. – BUILDING CODE   

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Chapter 18 Article II Section 18-32 of the Gadsden City Code is amended to read as follows:

Sec. 18-32. – Amendments.

The following sections are hereby revised:

Section 101.1 Title. These regulations shall be known as the Building Code of the City of Gads-den, hereinafter referred to as “this code.”

Section 113.1 through 113.4 and Appendix B. Board of Appeals. These sections and Appendix B (Board of Appeals) are not adopted. All appeals shall be to the building code board of appeals as established by Section 18-34(a) of the City Code.

Section 1612.3 Establishment of flood hazard areas. To establish flood hazard areas, the city council shall adopt a flood hazard map and supporting data. The flood hazard map shall include, at a minimum, areas of special flood hazard as identified by the Federal Emergency Management Agency in an engineering report entitled The Flood Insurance Study for the City of Gadsden, Alabama, dated April 4, 1983, as amended or revised, with the accompanying Flood Insurance Rate Map (FIRM) and Flood Boundary and Floodway Map (FBFM) and related sup-porting data, along with any revisions thereto. The adopted flood hazard map and supporting data are hereby adopted by reference and declared to be part of this section.

Section 2.Chapter 18 Article II Section 18-33 of the Gadsden City Code is amended to read as follows:

ORDINANCE NO. O-02-24

Amending City Code Chapter 18 – BUILDINGS AND BUILDING REGULATIONS

ARTICLE III. – ELECTRICAL CODE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Chapter 18 Article III Section 18-63 is amended to read as follows:

(a)The following sections are hereby revised:

Section 334.10 Uses Permitted

(1) One- and two-family dwellings and their attached or detached garages, and their storage buildings.

(2) Multi-family dwellings permitted to be of Types III, IV, and V construction.

(3) Other structures permitted to be of Types III, IV and V construction. Cables shall be concealed within walls, floors or ceilings that provide a thermal barrier of material that has at least a 15-minute finish rating as identified in listings of fire- rated assemblies.

Section 334.12 Uses Not Permitted

(A) Types NM and NMC. Types NM and NMC cables shall not be permitted as follows:

(1) In any dwelling or structure not specifically permitted in 334.10(1), (2), ( 3) and (5).

(2) Exposed within a dropped or suspended ceiling cavity in other than one- and two-family and multifamily dwellings.

(3) As service-entrance cable.

(4) In commercial garages having hazardous (classified) locations as defined in 511.3.

(5) In theaters and similar locations, except where permitted in 518.4(B).

(6) In motion picture studios.

(7) In storage battery rooms.

(8) In hoistways or on elevators or escalators.

(9) Embedded in poured cement, concrete or aggregate.

(10) In hazardous (classified) locations, except where specifically permitted by other  articles in this Code.

(B) Type NM. Type NM cables shall not be used under the following conditions or in the following locations:

(1) Where exposed to corrosive fumes or vapors.

(2) Where embedded in masonry, concrete, adobe, fill or plaster.

(3) In a shallow chase in masonry, concrete, or adobe and covered with plaster, adobe or a similar finish.

(4) In wet or damp locations.

(b) The following provisions shall apply in lieu of any contradictory provision of the National Electrical Code, 2020 edition:

(A) Metallic conduit.

(1) All wiring of 50 volts or above in commercial, industrial or institutional buildings within the City shall be in metallic conduit.

2) Nonmetallic schedule 40 or 80 electrical type conduit may be used in a slab, provided a rigid conduit 90-degree bend extends from the slab.

(B) Service disconnect. A main service disconnect switch is required to be placed outside on all residential and commercial buildings where the electrical service to the building is fed from overhead or fed underground through a direct meter socket and the meter base and the main panel cannot be placed back to back with each other.

(C) Shunt trip breaker. For an underground service application where there is no main service disconnect switch outside and the main panel is located inside the building, a shunt trip breaker will be required, with the shunt trip mechanism placed as close as possible to the meter base.

(D) Engineered drawings. A set of drawings signed and sealed by a licensed electrical engineer will be required on all buildings that are 2500 square feet or more or where the cost of the electrical work exceeds 10% of the cost of the job.

Section 109.2 Schedule of Permit Fees. Where work requires a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority.

Section 109.6 Refunds. The code official is authorized to establish a refund policy.

Section 115.4 Violation Penalties. Persons who shall violate a provision of this code, fail to comply with any of the requirements thereof or erect, install, alter or repair work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a violation punishable by a fine of not more than $500.00 or by imprisonment not exceeding six (6) months, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

Sections 116.1 through 116.4 Stop Work Order

Section 116.1 Authority. Where the code official finds any work regulated by this code being performed in a manner contrary to the provisions of this code or in a dangerous or unsafe manner, the code official is authorized to issue a stop work order.

Section 116.2 Issuance. The stop worker shall be in writing and shall be given to the owner of the property, the owner’s authorized agent or the person performing the work. Upon issuance of a stop work order, the cited work shall immediately cease. The stop work shall state the reason for the order and the conditions under which the cited work is authorized to resume.

Section 116.3 Emergencies. Where an emergency exists, the code official shall not be required to give a written notice prior to stopping the work.

Section 116.4 Failure to comply. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be subject to fines established by the authority having jurisdiction.

Section 113. Means of Appeal. Sections 113.1 through 113.4 are not adopted. All appeals shall be to the building code board of appeals established by Section 18-34(a) of the City Code.

Section 2. Chapter 18 Article IV of the Gadsden City Code is further amended to add the following:

Section 3. The provisions of this ordinance shall be effective upon publication.

Section 4.

The sections, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.

Section 5. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.
