ORDINANCE NO. O-61-23

Adopting Fiscal Year 2024 Budgets

Whereas, in compliance with §11-43B-10, 1975 Alabama Code, after proper notice given by publication, a hearing has been held to receive public comment on the proposed budgets for fiscal year 2024;  

Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. The budget document entitled General Fund Budget, filed with the City Clerk-Treasurer, together with all schedules and exhibits thereto, is hereby adopted as the General Fund Budget of the City of Gadsden, Alabama, for the fiscal year ending September 30, 2024.

Section 2. The FY2024 General Fund Budget provides for total anticipated income in the amount of $60,250,513.

Section 3. The FY2024 General Fund Budget appropriates the amount of $57,844,399 to the Departmental Budgets and the Non-Departmental Budget.

Section 4. The FY2024 General Fund Budget appropriates the amount of $1,552,500 to Outside Agency Appropriations.  The Mayor on behalf of the City is hereby authorized to enter into a contract with each organization for the performance of a public purpose in the amount authorized in the budget.

Section 5. The FY2024 General Fund Budget appropriates the amount of $853,614 to Transfers to Other Funds.

Section 6. The FY2024 General Fund Budget appropriates the amount of $210,000 to Coun-cil Discretionary Funds.  The Mayor on behalf of the City is hereby authorized to enter into a contract in the amount and with each organization for the performance of a public purpose as authorized by each Council Member.

Section 7. The budget document entitled Special Revenue Funds, filed with the City Clerk-Treasurer, is hereby adopted as the Special Revenue Funds Budget of the City of Gadsden, Ala-bama, appropriating $8,442,287 for the fiscal year ending September 30, 2024.

The budget document entitled Enterprise and Internal Service Funds (Airport, Golf Course, Residential Garbage and Employee Insurance), filed with the City Clerk-Treasurer, is hereby adopted as the Enterprise and Internal Service Funds Budget of the City of Gadsden, Alabama, appropriating $15,716,165 for the fiscal year ending September 30, 2024.

Section 10. The budget document entitled Capital Projects Fund, filed with the City Clerk-Treasurer, is hereby adopted as the Capital Projects Fund Budget of the City of Gadsden, Ala-bama, appropriating $9,200,000 for the fiscal year ending September 30, 2024.

Section 11. The budget document entitled Capital Projects Fund II, filed with the City Clerk-Treasurer, is hereby adopted as the Capital Projects Fund II Budget of the City of Gadsden, Ala-bama, appropriating $8,500,000 for the fiscal year ending September 30, 2024.

Section 12. In accordance with generally accepted accounting principles (GAAP), encum-brances outstanding as of September 30, 2023, shall be closed to the fund balance and re-established at the beginning of the new fiscal year as a reduction to the prior year’s budget and as an increase to the new fiscal year’s budget.

The Director of Finance and the City Clerk-Treasurer will maintain true and cor-rect copies of the official budgets in their offices at all times during this fiscal year and make it available for public inspection during normal business hours. The Water Works and Sewer Board of The City Of Gadsden will a hold a public meeting on Wednesday, October 18, 2023, at 5:30 p.m. at The Water Works and Sewer Board Of The City Of Gadsden office located at 515 N Albert Rains Boulevard, Gadsden, Alabama to discuss the Environmental Information Document and related items required as part of the submission of an application for funding through the Clean Water State Revolving Fund as administered by the Alabama Department of Environmental Management (ADEM). This application will address sanitary sewer system improvements through gravity sewer collection system rehabilitation.  A copy of the Environmental Information Document (EID) will be available at The Water Works and Sewer Board Of The City Of Gadsden office for public review.

Notice of Public Meeting on Proposed Economic Development Agreement

The City Council of the City of Attalla will hold a public meeting on October 16, 2023 at 10 a.m., during the regular 3rd Monday of the month council meeting, to consider the adoption of a res-olution authorizing an economic development agreement with RaceTrac Alabama, INC., a Georgia Corporation (RaceTrac) authorized to do business in Alabama, which proposes to lo-cate a service station on the property along 3rd Street NW (US HWY 11) between 3rd Avenue NW and 4th Avenue NW in Attalla. The development is expected to generate $200,000, annual-ly in revenue to the City from merchant sales and fuel sales. The City proposes to pay RaceTrac $300,000 from revenue generated from sales at RaceTrac, beginning when the business is open to the public and conducting business. The City will make quarterly payments to Race Trac, which will total the revenue generated from the City’s 5% sales tax and fuel tax. The payment will stop when the $300,000 is reached. The money paid to RaceTrac will help pay for Storm Sewer System that crosses the property and must be relocated so RaceTrac can develop the service station on the property. The City of Attalla seeks to increase employment and to increase the tax and revenue base of the City. All interested persons may examine and review the Agreement and Resolution in the office of the City Clerk during normal business hours, be-fore and after the meeting referenced herein.

Sealed proposals will be received by the City Clerk, City of Gadsden, Alabama, at the City Hall, 90 Broad Street, Room 411, Gadsden, Alabama until 2:00 P.M., Tuesday, OCTOBER 31, 2023, for the  THOMSPON COMMUNITY CENTER & GYM REROOFING PROJECT, Bid Request No. 3523, located in the City of Gadsden, Alabama.

Bids submitted prior to the bid opening by mail shall be directed to “City Clerk, P.O. Box 267, Gadsden, Alabama 35902-0267” or in person delivered to the office of the City Clerk, Room 401, City Hall, 90 Broad Street, Gadsden, Alabama.

Bids will be publicly opened and read at the above time and place. Specifications and contract documents are open to the public for inspection at the City Hall. Electronic (pdf) specifications and contract documents can be distributed at no cost. All bidders must be registered with the City of Gadsden Engineering Department in order to submit a bid. Bids received from unregis-tered bidders will be rejected.

The bidder shall file with his bid either a cashier’s check drawn on an Alabama bank, payable to the City of Gadsden, Alabama, or a bid bond executed by a surety company duly authorized and qualified to make such bonds in Alabama, in an amount equal to the lesser of five percent (5%) of the bid or ten thousand ($10,000).

The Owner reserves the right to waive any informalities or to reject any and all bids.

The successful bidder will be required to furnish and pay for the satisfactory Performance and Payment Bond or Bond in the amount required by Section 39-1-1(a), Code of Alabama 1975, and evidence of insurance as required by the bid documents within ten (10) days after being notified that he has been awarded the contract.

No bidder may withdraw his bid within sixty (60) days after the actual date of the opening thereof.  The bidder must comply with all requirements of the public works bid law Section 39-2-1 et seq., Code of Alabama 1975.

Any bidder, whether a resident or non-resident of the State of Alabama, must comply with all applicable provisions of Section 34-8-1, et. seq., Code of Alabama, 1975, including require-ments for licensing as a general contractor and the necessity to show evidence of license, with a specialty in landscaping or grass cutting, before the bid will be considered by the awarding authority.  A current license number must be included on the bid.

Bidders must comply with the President’s Nos. 11246 and 11375 which prohibit discrimination in employment regarding race, creed, color, sex, or national origin. Bidders shall prequalify for this project. Prequalification proposals for General Contractors will be received at the office of the Director of Engineering, City of Gadsden, Alabama, located in room 302 on the 3rd floor of City Hall, 90 Broad Street, Gadsden, Alabama until 4:00 P.M., Fri-day, October 20, 2023. A Mandatory Attendance Pre-Bid Meeting will be held on-site at the Gadsden State Community College Sports Complex on Monday, October 30, 2023, at 2 PM. Sealed construction proposals will be received by the City Clerk, City of Gadsden, Alabama, at the City Hall, 90 Broad Street, Room 411, Gadsden, Alabama until 2:00 P.M., Tuesday, November 7, 2023, for furnishing all labor, materials, equipment, and services required to complete the GADSDEN SPORTS PARK, PHASE IV, Bid Request No. 3519, located in the City of Gadsden, Alabama. 

Bids submitted prior to the bid opening by mail shall be directed to “City Clerk, P.O. Box 267, Gadsden, Alabama 35902-0267” or in person delivered to the office of the City Clerk, Room 401, City Hall, 90 Broad Street, Gadsden, Alabama.

Bids will be publicly opened and read at the above time and place. Plans, Specifications, and Contract Documents are open to the public for inspection at the City Hall. Electronic (pdf) Plans, Specifications, and Contract Documents may be obtained from the City of Gadsden Engineering Department, Room 301, City Hall, 90 Broad Street, Gadsden, Alabama by calling (256)-549-4520. All bidders must be registered with the City of Gadsden Engineering Department in order to submit a bid. Bids received from unregistered bidders will be rejected.

The bidder shall file with his bid either a cashier’s check drawn on an Alabama bank, payable to the City of Gadsden, Alabama, or a bid bond executed by a surety company duly authorized and qualified to make such bonds in Alabama, in an amount equal to the lesser of five percent (5%) of the bid or ten thousand ($10,000).

The apparent low bidder will be required to submit their list of subcontractors within two days of the bid opening date to confirm compliance with the experience and qualification require-ments listed in the technical specifications of each applicable trade before being considered for award

The Owner reserves the right to waive any informalities or to reject any and all bids.

The successful bidder will be required to furnish and pay for the satisfactory Performance and Payment Bond or Bond in the amount required by Section 39-1-1(a), Code of Alabama 1975, and evidence of insurance as required by the bid documents within ten (10) days after being notified that he has been awarded the contract.

No bidder may withdraw his bid within sixty (60) days after the actual date of the opening thereof.  The bidder must comply with all requirements of the public works bid law Section 39-2-1 et seq., Code of Alabama 1975.

Any bidder, whether a resident or non-resident of the State of Alabama, must comply with all applicable provisions of Section 34-8-1, et. seq., Code of Alabama, 1975, including require-ments for licensing as a general contractor and the necessity to show evidence of license be-fore the bid will be considered by the awarding authority. Bidder must have a BCU4 license with either a major HS or MU classification, or a portion of the project applicable specialties under either or both HS or MU classifications at a minimum to be considered for award.  A cur-rent license number must be included on the bid in accordance with section 102.1 of the bid documents.
