Amending Ordinance No. O-47-23

Amending City Code Article IV. – DOGS AND CATS

WHEREAS, the unchecked reproduction of domestic animals has led to an overpopulation crisis in our community, resulting in overcrowded animal shelters and posing a threat to public safe-ty; and

WHEREAS, spaying and neutering are proven methods to control the breeding of dogs and cats, reducing the number of unwanted litters and thereby alleviating the burden on animal shelters and taxpayers, benefiting both the individual animals and the community as a whole; and

WHEREAS, spaying and neutering not only prevent health issues like certain reproductive can-cers and diseases, but also reduce the risk of aggressive behavior and roaming; and

WHEREAS, owners are able to pursue various discount certificates and programs for the spay-ing and neutering of dogs or cats. More information regarding these resources can be found on the City of Gadsden’s website; and

WHEREAS, promoting responsible pet ownership is a critical step in ensuring the humane treatment of animals and fostering a more compassionate and responsible community;

Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, that Ordinance No. O-47-23 is amended to read as follows:

Section 1. Article IV. – DOGS AND CATS of the Code of Ordinances of the City of Gadsden is amended by adding the following:

Sec. 10-18. – Managed Care of Dogs and Cats.

(a) Registration of dogs and cats. The owner or person in charge of a dog or cat that is more than six (6) months of age and resides in the City shall register the dog or cat with the City or its authorized agent. The owner or person in charge shall provide to the registrar the following:

(1) The name, breed, color, age, gender and other identifying characteristics of the dog or cat.

(2) The name, address, and telephone number of the owner, person in charge, and/or residence of the dog or cat; and

(3) Valid proof that the dog or cat has been inoculated against rabies in accordance with state and local law.

(b) License for dogs and cats. The owner or person in charge of a dog or cat that is required to be registered, as set forth above in subsection (a), shall obtain either an annual or lifetime license for each dog or cat from the City’s Revenue Department or the City’s authorized agent, and shall be issued a metal tag or decal suitable for affixing to the dog or cats’ collar as evi-dence of such license. The annual license shall be effective for three hundred sixty-five (365) days from the date of issuance and must be renewed each year before its expiration during the lifetime of the dog or cat. The lifetime license shall only be issued for a dog or cat that has been spayed or neutered, and it shall be effective for the life of the dog or cat. No license shall be issued without proof that the dog or cat has received a valid rabies vaccination.

(c) Exceptions.

(1) A dog or cat that is incapable of breeding or medically unsuited to undergo a spay or neuter procedure due to legitimate health reasons. A letter or certificate from a licensed veterinarian shall be required in all such cases.

(2) A dog or cat that is undergoing or has received appropriate training and certification by a recognized agency and is utilized or is retired from use by a law enforcement agency for law enforcement purposes or by a search and rescue team for search and rescue purposes. 

(3) A dog or cat that is a breed approved by and registered with the American Kennel Club or similar registry recognized by the Division, and the dog or cat is actively used to exhibit or compete and has competed in at least one legitimate exhibition or competition hosted by the American Kennel Club within the last year.

(4) A service animal as defined by Alabama Code §21-7-4 (1975).

(5) A dog or cat in the care of a State registered 501(c)3 Rescue Organization with a valid City of Gadsden business license.

(5) For each exception above, the owner must provide proof thereof.

(d) Annual and lifetime license fees.

(1) The owner or person in charge shall pay a fee to the City for each annual or lifetime license, in the amounts set forth below, which is to be charged to offset the costs of the registration, licensing and control of dogs and cats within the City.

(2) In order to obtain an annual license or lifetime license for a dog or cat that has been spayed or neutered, the owner or person in charge shall provide proof of sterilization by letter or certificate signed by a licensed veterinarian and identifying the dog or cat by name, description, breed, color, age, gender, and owner or person in charge. Alternatively, the owner or person in charge may submit the dog or cat to physical examination by the City’s animal control officer for the purpose of verifying its sterilization. 

(3) The owner or person in charge may submit a letter or certificate from a licensed veterinarian stating that a dog or cat should not be sterilized, either because it is less than six (6) months old or for other legitimate health reasons. In such cases, the owner or person in charge may obtain an annual license by payment of the fee in the amount charged for sterilized dogs or cats.

(4) The owner or person in charge of a dog or cat that has been spayed or neutered may provide proof that he or she has an annual income of no more than thirty-five thousand dollars ($35,000.00) or that he or she is a recipient of Medicaid, Social Security Disability or Supplemental Nutrition Assistance Program. In such case, the owner or person in charge shall receive a lifetime license for the sterilized dog or cat without paying the license fee.

(5) In the event that the owner or person in charge renews an annual license for a dog or cat more than thirty (30) days after the expiration of the license, he or she shall pay a five dollar ($5.00) late fee in addition to the annual license fee.

(6) Fifty percent (50%) of the proceeds collected from pet license fees shall annually be appropriated to the Humane Society to support a spay-neuter program. The remaining fifty percent (50%) of the proceeds collected from pet license fees shall be dedicated to the administration of animal control within the City.

(e) Commercial breeder permit. If any person owns or maintains an unsterilized dog or cat appearing to be of more than six (6) months of age for the purposes of commercial breeding, he or she may do so lawfully by obtaining a special Commercial Breeder per-mit from the City in addition to their regular business license. This permit shall be re-newed annually on the same timeline as regular business licenses are due. Anyone holding a valid such license shall be exempt from penalty under this section.

(1) A commercial breeder is any person or business that breeds one (1) or more domestic cat(s) or dog(s) or offers one (1) or more domestic cat(s) or dog(s) for breeding or stud purposes, producing three (3) or more litters per year, or offers kittens and puppies that are the result of such breeding for sale. A commercial breeder shall submit a completed breeder application, a copy of his or her verified photo identification, and shall remit $200.00 to the Revenue Department prior to permit approval. The Revenue Department shall notify the Animal Control department, the Chief of Police, and any other such person as designated by the Mayor of each licensed commercial breeder within the City annually. The City may require an on-site inspection prior to the issuance of a commercial breeder permit.   

(2) In the event a commercial breeder renews a commercial breeder permit more than thirty (30) days after the expiration of their current permit, he or she shall pay a five dollar ($5.00) late fee in addition to the commercial breeder permit fee.

(2) Fifty percent (50%) of the proceeds collected from the special commercial breeder permit fees shall annually be appropriated to the Humane Society to support a spay-neuter program. The remaining fifty percent (50%) of the proceeds collected from pet license fees shall be dedicated to the administration of animal control within the City.

(f) Penalties. If a dog or cat is determined to be at large, or is otherwise captured or dis-covered by the city’s officers responsible for animal control, and said dog or cat is unli-censed or its license is expired by more than thirty (30) days, the owner(s) of said dog or cat shall be subject to a fine of $100 for the first offense, $200 for the second of-fense, and $300 for the third offense. Additionally, if said dog or cat appears to be of at least six months of age and is not sexually sterilized (i.e., spayed or neutered) and is not appropriately licensed, the animal’s owner(s) shall be subject to a fine of $500.

Section 2. The section, subsections, paragraphs, sentences, clauses and phrases of this ordi-nance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, para-graph, sentence, clause and phrase of this ordinance.  The city council declares that it is its in-tent that it would have enacted this ordinance without such invalid or unconstitutional provi-sions.

Section 3. The provisions of this ordinance repeal any prior ordinance or provision of the Gads-den City Code to the extent of any conflict.

Section 4.  This Ordinance shall become effective on October 10, 2023, with a 30-day grace pe-riod whereby warning citations will be imposed under this Ordinance in lieu of fines and penal-ties. Adopted this ordinance at an open public meeting held on October 10, 2023.
