ORDINANCE NO. O-72-23

Amending City Code Section 102-92. – Health and life insurance premium rates for retirees

and part-time employees.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Section 102-92 of the Code of Ordinances of the City of Gadsden is amended to read as follows:

Sec. 102-92. – Health and life insurance premiums for retirees.

(a) All employees who continue health insurance coverage after retirement shall pay a monthly premium on or before the first day of each month for that month.

(b) Monthly premium rates for health insurance for retirees are as follows:

(1) All current and future retirees choosing to continue health insurance coverage post- retirement shall pay 45% of the current premium for each year.

(c) Impact of Medicare eligibility on health insurance coverage, effective on and after October 1, 2012.

(1) Notwithstanding the above, at the time a retiree (regardless of his or her date of retirement) becomes eligible (whether enrolled or not) for Medicare (“Medicare- eligible”), such retiree shall no longer be entitled to the subsidized premium rates for health insurance coverage under any retiree health plan offered by the city to its retirees, except as provided in section (c)(2).

(2) Notwithstanding [section] (c)(1) above, the following exceptions apply to a retiree who terminated, employment prior to May 1, 2012, who, as of May 1, 2012, is covered under the retiree health plan offered by the city (“Retiree Health Plan”) and is Medicare-eligible (an “affected retiree”). If an affected retiree has subsidized single coverage or an affected retiree, whose spouse is Medicare-eligible, has subsidized family coverage under a retiree health plan, the city shall make available to such affected retiree coverage for the affected retiree under a Medicare-supplemental policy selected by the city (AM-WINS) (“Medicare- supplemental policy”) and shall provide a $200.00 per calendar month subsidy toward the cost of premiums for the Medicare-supplemental policy (AM-WINS); additionally, the city shall make available to such Medicare-eligible spouse coverage under a Medicare-supplemental policy (AM-WINS), but such coverage will not be subsidized by the city.

(d) Employees who are retired may retain life insurance coverage by paying the full monthly premium of the group term policy.

(e) Nothing in this section or any other provision of this Code shall be construed in such a way as to violate the Age Discrimination in Employment Act, the Older Workers Benefit Protection Act, or similar anti-discrimination laws and regulations relating to age and disability. The city shall provide exactly the same benefits to employees over the age of 65 as it provides to employees under the age of 65, regardless of the presence or absence of Medicare coverage.

Section 3. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions. 

Section 4. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 5. This ordinance shall become effective on January 1, 2024. Adopted this ordinance at an open public meeting held on October 31, 2023.
