NOTICE OF MORTGAGE FORECLOSURE SALE

STATE OF Alabama COUNTY OF ETOWAH

Default having been made of the terms of the loan documents secured by that certain mortgage executed by Douglas L. Clemons An Unmarried Man Perminio F Lopez   to Dynex Financial of Alabama, Inc. dated June 7, 2000; said mortgage being recorded on June 8, 2000, in Book 2000, Page 160 in the Office of the Judge of Probate of Etowah County, Alabama. Said Mortgage was last sold, assigned and transferred to LaSalle Bank National Association as Trustee by assignment recorded in Deed Book 2001, Page 156 in the Office of the Judge of Probate of Etowah County, Alabama.

Notice is hereby given to you that a Petition has been filed in this Court under the

provisions of Article 17 (Sections 6-6-750 et seq.), Chapter 6, Title 6, Code of Alabama 1975 (the “Validation Law”), requesting that the Court determine the legality of and validate and confirm: the obligations of the City of Attalla, Alabama (“City”) adopted in its Ordinance No. 2021-4 (the “Authorizing Ordinance”) authorizing the issuance and sale of the City’s “General Obligation Warrants, Series 2021-C” in the principal amount of up to Nine Million Five Hundred Thousand and No/100 ($9,500,000.00) Dollars (the “Series 2021-C Warrants”) to (i) refund and redeem, on a current basis, its outstanding $3,030,000 General Obligation Warrant (AMFund), Series 2006, dated January 12, 2006, (the “2006 AMFund Warrant’’) (ii) refund and redeem, on a current basis, its outstanding $5,840,000 Tax Exempt General Obligation Sewer Warrants, Series 2015-A, dated

October 22, 2015 (the “Series 2015-A Warrants”), (iii) to provide funds for certain public capital improvements within the City; and, (iv) to pay the costs of issuing the Series 2021-C Warrants.

as more particularly described in said Petition and proposed to be issued by the City under the authority of the constitution and laws of the State of Alabama, including particularly Sections 93, 94, 225 and 225.01 of the Constitution of Alabama of 1901 and Section 11-47-2 of the Code of Alabama (1975); the pledges and other covenants, provisions and agreements referred to in said Petition; and all proceedings respectively had or taken in connection therewith.

The indebtedness evidenced and ordered paid by the Series 2021-C Warrants will be a

general obligation of the City for the payment of which the full faith and credit of the City will be irrevocably pledged.

All interested persons may examine and review all relevant documents pursuant to which

the Series 2021-C Warrants are to be issued, and make copies thereof at personal expense, at the offices of the City Council of the City of Attalla during normal business hours. Further information concerning the information in this notice can be obtained from the office of the City Council of the City of Attalla during normal business hours.

The Court has issued an order against the taxpayers and citizens of the City of Attalla,

Alabama, requiring them, at a hearing of said Petition to be held in Circuit Courtroom Place No. 2 in the County Courthouse of Etowah County in the City of Gadsden, Alabama, on the 10th day of December, 2021, at 10:00 o’clock a.m. to show cause, if any they have, why (i) the Authorizing Ordinance and the obligations of the City thereunder, (ii) the issuance of the Warrants, , (ii) the pledges and other covenants, provisions and agreements referred to in said Petition, and (iii) all proceedings respectively had or taken in connection therewith, should not be validated land confirmed.

ORDINANCE NO. O-15-21

Amending Fiscal Year 2022 Budget

WHEREAS, the City of Gadsden applied for and accepted a grant from the Edward Byrne Memorial Justice Assistance Grant (JAG) in the amount of $35,458.00 to be allocated as follows:

The Gadsden Police Department will purchase a new X-Ray System for the Bomb Squad with all peripherals and accessories, in the amount of $34,394.00, as well as provide education & training in NIBRS compliance as required by the Department of Justice, in the amount of $1,064.00.

The Etowah County Sheriff Office has opted to defer funding from this solicitation due to the Joint Special Operations Agreement for the Gadsden Bomb Squad to assist in all potential explosive incidents within Etowah County.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, that the General Fund Budget adopted by Ordinance No. O-12-21 (Fiscal Year 2022 Budget), is amended by increasing the following accounts:

CITY OF GADSDEN COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM

The City of Gadsden will hold a public hearing on November 29, 2021 at 12:00 Noon to discuss the 2022 Program Year Community Development Block Grant (CDBG) which will begin June 1, 2022.  The public hearing will be held at 90 Broad Street in the City Council Chambers of Gadsden City Hall.   

The primary objective of the Community Development Block Grant Program is to develop viable urban communities by providing decent housing, a suitable living environment, and by expanding economic opportunities; principally for persons of low-to-moderate income.

Written comments will be received until December 30, 2021.

Plans and Proposals are available at the Alabama Department of Transportation, 1409 Coliseum Boulevard, Room E-108, Montgomery, AL 36110.
