ORDINANCE NO. O-76-23

Amending City Code Chapter 110 – Streets, Sidewalks and Other Public Places

ARTICLE IV. – IMPROVEMENTS; MAINTENANCE; EXCAVATIONS

DIVISION 2. – PERMIT

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Chapter 110 Article IV Division 2 of the Code of Ordinances of the City of Gadsden is amended to read as follows:

DIVISION 2. – PERMIT

Sec. 110-131. Required.

It shall be unlawful for any person or entity within any public street or public right-of-way which has been accepted by the city for maintenance, or within any area in the city that has been dedicated by plat or otherwise as a public park or right-of-way, or over which the public will have right of ingress and egress, to make any improvement, excavation, alteration, construction or drainage facilities, or to make any change or alteration in, above, or beneath any street, curb or sidewalk pavement, without first obtaining a written permit from the engineering department.

Sec. 110-132. Application.

The engineering department shall have the right to require any person desiring to perform any of the acts stated in section 110-131 to submit in writing an application with plans, proposals or specifications with respect to any work, improvement, change or alteration of any kind referred to in such section. Applications for permits required by this division shall list the name(s) and primary contact information of the contractor, if any, who is to do the work, the exact location of the site along with other information as may be required by the engineering department.

Sec. 110-133. Plan approval.

The engineering department shall, after the application for the permit required by this division is made, investigate the situation, examine the plans, specifications and reports and thereafter notify the permittee of any deficiencies found. Once the application is determined to be complete to the satisfaction of the engineering department, the permit will be issued. 

Sec. 110-134. Use of standard plans.

In providing the plans, specifications and instructions to be included in the permit provided for by this division, the engineering department shall have the right to use plans and specifications with respect to types of work and the requirements therefor which may be on file in the engineering department’s office and made available to persons proposing to do the work or construction.

Sec. 110-135. Deviations from approved plans.

It shall be unlawful for any person within the area sought to be improved pursuant to the provisions of this division to make any construction, excavation, alteration, or improvement, or provide or install or change drainage or drainage facilities, that does not meet the final plans, specifications and directions issued by the engineering department for the work to be done, and no deviation shall be made from the work or improvement as outlined in the permit issued by the engineering department without the written approval of the engineering department.

Sec. 110-136. Bond.

Before the engineering department shall issue the permit required by this division, the engineering department may require the person proposing to do the work outlined in this division to execute a bond measured by the estimated value or cost of the improvement with duly authorized surety company as surety, or, in lieu of a surety, a bond secured by cash deposit. Such bond shall be payable to the city, approved by the city clerk and conditioned that the person engaged in the work will faithfully observe the provisions of this article, that the city will be indemnified against and saved harmless from all claims arising from accidents or damages of any character whatsoever caused by the negligence of such person engaged in performing the work or by any other inadequate or insufficient work done either by the person, contractor or agents or employees, and that such person will maintain in a safe condition for a period of one year all work done and performed.

Sec. 110-137. – Standard permit requirements.

Should a permit application be submitted that will result in a street being excavated that was paved within ten (10) years from the date the application is received, the permittee shall be required to mill the entire width of the road 1.5” from intersection to intersection and replace the asphalt with 165 LB/SY of ALDOT 424A Wearing Surface Mix (or alternate mix approved by the engineering department). Any subgrade repairs needed within the project area shall also be completed by the permittee at the direction of the engineering department in order the ensure that the roadway is returned to pre-existing condition. All material and workmanship shall be completed in accordance with the Alabama Department of Transportation Standard Specifications for Highway Construction, latest edition.

All utility installations shall be installed in accordance with the Alabama Department of Transportation’s standards for accommodating utilities on highway rights of way. Variances shall only be allowed under the approval and direction of the engineering department.

Secs. 110-138—110-160. Reserved.

Section 2. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.

Section 3. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 4.  This ordinance shall become effective upon publication.
