STATE OF ALABAMA PROCLAMATION BY THE GOVERNOR

WHEREAS the Alabama Legislature at its 2019 Regular Session enacted Act No. 2019-165 (SB270), which ordered an election to be held on a proposed amendment to the Constitution of Alabama of 1901 relating to Etowah County, Alabama; and

WHEREAS notice of this election, together with the proposed amendment, is required by law to be given by proclamation of the Governor, to be published once a week for four successive weeks preceding the date appointed for the election in each newspaper qualified to run legal notices in the county affected;

NOW, THEREFORE, I, Kay Ivey, as Governor of the State of Alabama, do hereby give notice, direct, and proclaim that on Tuesday, March 3, 2020, an election will be held in Etowah County, Alabama, in the manner and form provided by law upon the following amendment to the Constitution of 1901 of the State of Alabama:

AMENDMENT PROPOSED BY ACT NO. 2019-165 (SB270)

Effective beginning the first day of the next month after the ratification of this amendment, any allowances or other amounts received by the Sheriff of Etowah County for feeding prisoners shall be deposited in a separate account in the county treasury to be known as the “Sheriff’s Discretionary Fund.” The Sheriff’s Discretionary Fund shall be used by the sheriff for the feeding of prisoners in the county jail and as provided herein. Any funds in the Sheriff’s Discretionary Fund over the amounts needed for the purposes provided above may be used by the sheriff for law enforcement purposes, for school resource officers, and for the operation of the office of the sheriff. Any funds in the Sheriff’s Discretionary Fund at the end of any fiscal year shall be carried over from year to year. In the event additional amounts are needed by the sheriff for the feeding of prisoners, the amounts shall be paid by the sheriff from any other funds appropriated or otherwise available for the operation of the office of the sheriff the expenditure of which is not otherwise restricted by law. The sheriff shall not be subject to the competitive bid law for the purchase of food or supplies used for feeding prisoners in the county jail.

ORDINANCE

O-03-20

AMENDING CERTAIN SECTIONS OF CHAPTER 10 OF THE CODE OF ORDINANCES OF THE CITY OF GADSDEN, ALABAMA

WHEREAS, the council for the City of Gadsden desires to amend its Animal Ordinance regarding Dangerous Dogs;

WHEREAS, the council for the City of Gadsden desires to amend the provisions relating to the cruelty of animals, so that a dog may not be kept through the use of a tether;

Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1.  Section 10-221 is amended by deleting numbers 2, 3 and 5 and should read as follows:

Sec. 10-221. – Definition of dangerous animal.

(1) Any mammal, amphibian, fish, reptile or fowl which is of a species which, due to size, vicious nature or other characteristics would constitute a danger to human life, physical well-being, or property, including but not limited to, lions, tigers, leopards, panthers, bears, wolves, apes, gorillas, monkeys of a species whose average adult weight is 20 pounds or more, foxes, elephants, alligators, crocodiles, and snakes which are venomous or otherwise present a risk of serious physical harm or death to human beings as a result of their nature or physical makeup including, but not limited to, boa constrictors, Madagascar ground boas, green and yellow anacondas, Cuban boas, Indian pythons, reticulated pythons, African rock pythons, Amethystine, pythons, Boelen’s pythons and all members of the family pythonid that exceed six feet in length.

(2) Any animal which is not naturally tame or gentle but is of a wild nature or disposition and which, because of its size, vicious nature or other characteristics, would constitute a danger to human life or property.

Section 2.  Section 10-222 is amended as follows:

Section 10-222. – Prohibition.

Except as provided in sections 10-223, 10-224, and 10-226, it shall be unlawful to own, keep, or harbor any dangerous animal in the city.

Section 3.  Section 10-225 is amended by replacing the current language with the following:

Sec. 10-225. – Control of Dangerous Dogs.

The keeping of a dangerous dog shall be subject to State Law, Code of Ala. 1975, Sec. 3-6A-1, et. Seq. Act 2018-182.

Section 4.  Section 10-72 is amended by replacing number 12 and should read as follows:

Section 10-72. – Cruelty to animals generally.

(12) Restrain a dog or dogs on a tether, rope, chain or similar line.

Section 5.  A violation of this ordinance shall be punished as provided in Section 1-7 of the Gadsden City Code.

Section 6.  Effective Date. This Ordinance shall be effective after the approval by the Council of the City of Gadsden and Mayor and publication as required by law, provided that the effective date shall be sixty (60) days after publication as required by law.

Section 7.  The sections, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable. If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance. The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.

Section 8.  The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.
