NOTICE is hereby given that a bill substantially as follows will be introduced in the 2023 Regular Session of the Legislature of Alabama and application for its passage and enactment will be made:

A BILL TO BE ENTITLED AN ACT

Relating to Etowah County; to provide that the director and employees of The Etowah County Punishment and Corrections Authority have arrest powers and may make arrests 12

in certain circumstances.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1. (a) The Director of The Etowah County Punishment and Corrections Authority and employees of the authority shall be considered law enforcement officers of this state with power to make arrests and serve arrest and search warrants while performing their official duties to the same extent as deputy sheriffs are authorized in their counties as

long as they hold current certification from the Alabama Peace Officers’ Standards and Training Commission. The powers of arrest under this section shall be limited to investigations and arrests of criminal acts committed at the authority’s program facilities and acts committed by persons under the authority’s supervision that are a violation of supervision or are a criminal offense.

(b) The authority director or corrections employee with law enforcement authority may arrest any person under his or her supervision without a warrant if he or she has probable cause to believe the person has committed a criminal offense or violated the conditions of supervision. In case of a warrantless arrest, the director or employee shall prepare a written warrant stating that the offender, in his or her judgment, has committed a criminal offense or violated a condition of supervision, and the warrant shall suffice to immediately bring the offender before the court to determine probable cause for the act described in the warrant. The court may order detention of the offender pending further hearing, after which the court may revoke probation or participation in the authority’s community corrections program, or both, pursuant to subdivision (d)(3) of Section 15-18-175, Code of Alabama 1975. 

(c) The director and employees of the authority given powers of arrest by this section shall be required to comply with the minimum standards for state law enforcement officers as certified by the Alabama Peace Officers’ Standards and Training Commission.   

Section 2. This act shall become effective on the first day of the third month following its passage and approval by the Governor, or its otherwise becoming law.

ADVERTISEMENT FOR BID- PIPE BURSTING

Sealed bids will be received, opened, and publicly read by the Owner for the 2023 Periodic Bid for Sewer Rehabilitation by Pipe Bursting Project.  The Owner will receive Bids until 11:00 AM (CST) on the 13TH  day of April  2023.  The bid opening will be held at the offices of The Water Works and Sewer Board of The City of Gadsden (GWWSB) located at 515 Albert Rains Boulevard, Gadsden, Alabama 35901.

A mandatory Pre-bid Meeting will be held at 11:00 AM (CST) on the 30TH day of March 2023.  The pre-bid Meeting will be held at the offices of The Water Works and Sewer Board of The City of Gadsden (GWWSB) located at 515 Albert Rains Boulevard, Gadsden, Alabama 35901.

The Project is for a periodic bid that consists of pipe bursting for the rehabilitation of sanitary sewer piping within the GWWSB’s service area. Each Work Authorization will be designated by GWWSB, or its consultant, as needed utilizing unit prices for commonly performed contractor work items. Construction of these projects is intended to be performed within the shortest possible time frame with the work beginning and ending on dates selected for each work authorization. ORDINANCE NO. O-15-23

Amending City Code Section 106-86(a)

Regarding Fee for Residential Garbage Collection   

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Section 106-86(a) of the Gadsden Code is amended to read as follows:

Sec. 106-86. Residential collection fee.

(a)   Monthly fee.  The fee for weekly residential garbage collection shall be $20.00 per month for each residence unit. 

Section 2. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions. 

Section 3. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 4.  This ordinance shall become effective on April 1, 2023.

Whereas pursuant to a Warranty Deed dated August 8, 1956, the City of Gadsden owns property located at 809 Vandell Boulevard, more particularly described as follows:

A tract or parcel of land described as beginning at a point on the east line of the NE ¼ of the NE ¼ in Section 12, Township 12 South, Range 5 East, which is 1040 feet south of the northeast  corner thereof, thence South 88 degrees 25 minutes west, and parallel with the south line of said forty a distance of 272.98 feet to the center of what is known as the South Eleventh Street Road, thence in a southerly direction and along the center of said road to a point which is 110 feet south, measured at right angles from the line first hereinabove described, thence east and parallel with the north line of said forty a distance of 230 feet to a point in the east line of said forty, thence north and along the east line of said forty a distance of 106 feet to the point of beginning, and being a portion of the NE ¼ of the NE ¼ in Section 12, Township 12 South, Range 5 East of Huntsville Meridian, in Gadsden, Etowah County, Alabama, said real estate being conveyed subject to streets and public ways over and across said tract as the same are now located.
