(b) All court costs and charges collected in Etowah County prior to the ratification of this amendment are hereby ratified, validated, and confirmed.”

(a) All sixteenth section and indemnity school land that is owned in fee simple by the Franklin County School System, is located in Fayette County and Walker County, and is for the exclusive use of schools in the Franklin County School System is vested in the Franklin County Board of Education. The board may manage, sell, lease, and control the land and any timber, minerals, or other natural resource of the land.

(b) Any proceeds generated from the sale of timber, minerals, or other natural resource of the land, or from the lease or sale of the land or its natural resources, shall be paid to the Franklin County Board of Education and deposited into the Franklin County Board of Education General Fund.

(c) It is the intent of the Legislature that this amendment supersede any other provision of this constitution that may be construed as conflicting with this amendment as it relates to the land and the rights, power, and control thereof and to the sale, lease, or other disposition of the land and timber, minerals, or other natural resource of the land, and any proceeds and interest earned there-from.

(d) Upon ratification of this amendment, all proceeds realized from the sale, lease, or other disposition of the land or the sale of timber, minerals, or other natural resource of the land occurring before ratification of this amendment, and held in trust by the State of Alabama, shall continue to be held in trust, and any proceeds and interest derived from those transactions shall be paid to the Franklin County Board of Education.

FURTHER, I proclaim and direct that this proclamation shall be published once a week for the four successive weeks immediately preceding Tuesday, November 5, 2024, in every county as required by law.

NOTICE TO CONTRACTORS FEDERAL AID PROJECT NO. STPAA-0291(501) ETOWAH COUNTY, ALABAMA

Sealed bids will be received by the Director of Transportation at the office of the Alabama Department of Transportation, Montgomery, Alabama until 10:00 AM on November 08, 2024 and at that time publicly opened for constructing the Micro- Milling, Resurfacing, and Traffic Stripe on SR-291 from the junction of SR-759 to the intersection of SR-1(US-431) in Gadsden. Length 0.890 mi.

The total amount of uncompleted work under contract to a contractor must not exceed the amount of his or her qualification certificate.

The Entire Project Shall Be Completed In Forty-five (45) Working Days. A 4.00% DBE Contract Obligation Is Required.

A Bidding Proposal may be purchased for $5.00. Plans may be purchased for $8.00 per set. Plans and Proposals are available at the Alabama Department of Transportation, 1409 Coliseum Boulevard, Room E-108, Montgomery, AL 36110. Checks should be made payable to the Alabama Department of Transportation. Plans and Proposals will be mailed only upon receipt of remittance. No refunds will be made.

Minimum wage rates for this project have been pre-determined by the Secretary of Labor and are set forth in the advertised specifications. This project is subject to the contract work hours and Safety Standards Act and its implementing regulations.

Cashier’s check or bid bond for 5% of bid (maximum – $50,000.00) made payable to the Alabama Department of Transportation must accompany each bid as evidence of good faith.

The bracket range is shown only to provide general financial information to contractors and bonding companies concerning the project’s complexity and size. This Bracket should not be used in preparing a bid, nor will this bracket have any bearing on the decision to award this contract.

The Bracket Estimate On This Project Is From $640,363 To $782,666 .

The proposed work shall be performed in conformity with the rules and regulations for carrying out the Federal Highway Act.

Authorizing TIF Funds for Expenditures

Related to US-431 Turn Lane Improvements

Whereas, the City Council of the City of Gadsden adopted Resolution R-562-24, authorizing an agreement with CDG, Inc. to provide the required construction engineering and inspection services required for the US-431 Turn Lane Improvements in East Gadsden; and

Whereas, the City Council of the City of Gadsden adopted Resolution R-549-24, awarding Bid No. 3570 for the US-431 Turn Lane Improvements to Massey Asphalt Paving, LLC; and

Whereas, the City Council finds and determines that the use of tax increment district funds for the rehabilitation of this structure is in keeping with the purpose and intent of the tax increment financing law and the project plans previously authorized and adopted.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Ordinance No. O-44-24 (Fiscal Year 2025 Budget), as amended, is further amended, by appropriating $339,098.00 to account #191-2500-419.75-10 (Street Improvements).

Section 2. The Mayor and Director of Finance are authorized to use funds from Tax Increment Financing (TIF) for this expense. These funds are hereby appropriated for such purposes.
