NOTICE OF DEFAULT AND FORECLOSURE SALE

WHEREAS, on October 26, 2011, a certain Mortgage was executed by Patricia H. Loveless, an unmarried woman, as mortgagor, in favor of One Reverse Mortgage, LLC, as mortgagee, and was recorded on November 9, 2011, in Instrument Number, 3357792; and subsequently transferred and assigned on October 26, 2011 to One Reverse Mortgage, LLC, and said assignment being recorded on December 30, 2011 in Instrument Number, 3360270; and subsequently transferred and assigned on  January 11, 2019 to Secretary Of Housing And Urban Development, and said assignment being recorded on June 3, 2019 in Instrument Number, 3484942; and

WHEREAS, the Mortgage was insured by the Secretary of Housing and Urban Development (“the Secretary”) pursuant to the National Housing Act for the purpose of providing single family housing; and

WHEREAS, a default has been made in the covenants and conditions of the Mortgage which remains wholly unpaid as of the date of this notice, and no payment has been made sufficient to restore the subject loan to currency; and

WHEREAS, the entire amount delinquent as of August 10, 2021, is $146,451.30; and

WHEREAS, by virtue of this default, the Secretary has declared the entire amount of the indebtedness secured by the Mortgage to be immediately due and payable;

NOW THEREFORE, pursuant to powers vested in the undersigned by the Single Family Mortgage Foreclosure Act of 1994 (“the Act”), 12 U.S.C. 3741 et seq., by 24 CFR Part 27, Subpart B, and by the Secretary’s designation of the undersigned as Foreclosure Commissioner, by instrument recorded on August 11, 2021 in Instrument Number, 3525693, aforesaid records, notice is hereby given that on October 25, 2021, between the hours of 11:00 A.M. and 4:00 P.M., local time, all real and personal property at or used in connection with the following described premises (“the Property”) will be sold at public auction to the highest bidder:

Said tract is situated in Etowah County, Alabama.

The sale will be held at the Etowah County Courthouse, in Gadsden, Alabama.  The Secretary will bid $148,273.19 plus the fees and costs associated with the sale.

There will be no proration of taxes, rents or other income or liabilities, except that the purchaser will pay, at or before closing, his/her/their/its prorata share of any real estate taxes that have been paid by the Secretary to the date of the foreclosure sale.

When making his/her/their/its bids, all bidders, except the Secretary must remit to the undersigned a deposit totaling $14,827.31 (10% of the Secretary’s bid) in the form of a certified check or cashier’s check made out to the Secretary of HUD.  Each oral bid need not be accompanied by a deposit.  If the successful bid is oral, a deposit of $14,827.31  same as 10% must be presented before the bidding is closed.  THE DEPOSIT IS NONREFUNDABLE.  The remainder of the purchase price must be delivered within 30 days of the sale or at such other time as the Secretary may determine for good cause shown, time being of the essence.  This amount, like the bid deposits, must be delivered in the form of a certified or cashier’s check.  If the Secretary is the high bidder, he/she need not pay the bid amount in cash.  The successful bidder will pay all conveyancing fees, all real estate and other taxes that are due on or after the delivery of the remainder of the payment, and all other costs associated with the transfer of title.  At the conclusion of the sale, the deposits of the unsuccessful bidders will be returned.

The Secretary may grant an extension of time within which to deliver the remainder of the payment.  All extensions will be for 15-day increments for a designated fee of 500.00, paid in advance.  The extension fee shall be in the form of a certified or cashier’s check made payable to the Secretary of HUD.  If the high bidder closes the sale prior to the expiration of any extension period, the unused portion of the extension fee shall be applied toward the amount due.

If the high bidder is unable to close the sale within the required period, or within any extensions of time granted by the Secretary, the high bidder may be required to forfeit the cash deposit or, at the election of the Foreclosure Commissioner after consultation with the HUD field office representative, will be liable to HUD for any costs incurred as a result of such failure.  The Commissioner may, at the direction of the HUD field office representative, offer the Property to the second highest bidder for an amount equal to the highest price offered by that bidder.

There is no right of redemption, or right of possession based upon a right of redemption, in the mortgagor(s) or others, subsequent to a completed foreclosure pursuant to the Act.  Therefore, the Foreclosure Commissioner will issue a deed to the purchaser(s) upon receipt of the entire purchase price in accordance with the terms of the sale as provided herein.  HUD does not guarantee that the property will be vacant.

The scheduled foreclosure sale shall be cancelled or adjourned if it is established, by documented written application of the mortgagor to the Foreclosure Commissioner not less than 3 days before the date of sale, or otherwise, that the default or defaults upon which the foreclosure is based did not exist at the time of service of this notice of default and foreclosure sale, or all amounts due under the mortgage agreement are tendered to the Foreclosure Commissioner, in the form of a certified or cashier’s check payable to the Secretary of HUD, before public auction of the property is completed.

The amount that must be paid if the Mortgage is to be reinstated prior to the scheduled sale is $148,273.19 as of October 25, 2021, plus all other amounts that would be due under the Mortgage agreement if payments under the Mortgage had not been accelerated, advertising costs and postage expenses incurred in giving notice, mileage by the most reasonable road distance for posting notices and or the Foreclosure Commissioner’s attendance at the sale, reasonable and customary costs incurred for title and lien record searches, the necessary out-of-pocket costs incurred by the Foreclosure Commissioner for recording documents, a commission for the Foreclosure Commissioner, and all other costs incurred in connection with the foreclosure prior to reinstatement.

Tender of payment by certified or cashier’s check or application for cancellation of the

foreclosure sale shall be submitted to the address of the Foreclosure Commissioner provided below.

Be it known that on 10-05-2021 the Etowah County Commission voted to vacate a portion of Bynum Road, Etowah County, Alabama.  Said portion of road being in Sections 28 and 29, T-12-S, R-3-E of the Huntsville Meridian, Etowah County, Alabama.  The resolution to vacate said roadway does hereby destroy the force and effect of any dedication of said roadway because of its appearance on the map of Etowah County, Alabama.

Etowah County Notice of Proposed Redistricting

The Etowah County Commission revised its six districts following the release of 2020 Census results. A map of the proposed districts is currently posted for public viewing outside the Commission Office (Suite 113) at 800 Forrest Avenue, Gadsden, AL 35901. The Commission will consider the new districts at its meeting on November 2, 2021 at 9:00 am in the Commission Chambers. Registered voters of Etowah County may submit questions or comments concerning the proposed new districts by emailing sellison@etowahcounty.org or in writing to Etowah County Commission, 800 Forrest Avenue, Suite 113, Gadsden, AL 35901.

Public Hearing option: Registered voters of Etowah County who wish to comment on the proposed new districts at the County Commission meeting may participate by signing in just prior to the 9:00 am meeting on November 2, 2021.

Sealed proposals will be received by Alabama Community College System

at Gadsden State Community College at the office of The Dean of Financial and Administrative Services, Joe Ford Center, GSCC East Broad Campus

until 2:00 pm CST, Tuesday, October 19, 2021 for Beck Field House HVAC at which time and place they will be publicly opened and read.  A mandatory pre-bid meeting will occur on Friday, October 15, 2021 at 10:00 am. 

A cashier’s check or bid bond payable to Gadsden State Community College

in an amount not less than five (5) percent of the amount of the bid, but in no event more than $10,000, must accompany the bidder’s proposal. Performance and Payment Bonds and evidence of insurance required in the bid documents will be required at the signing of the Contract.

Drawings and specifications may be examined at the office of B. Craig Lipscomb, Architect, 442 Chestnut Street, Gadsden, AL 35901.

Bid Documents may be obtained from the Architect upon deposit of $500 per set,

which will be refunded in full on the first set issued to each general contract bidder submitting a bonafide bid, upon return of documents in good condition within ten days of bid date. Other sets for general contractors, and sets for subcontractors and dealers, may be obtained with the same deposit, which will be refunded as above, less cost of printing, reproduction, handling, and distribution.  Digital documents are available from the Architect at no cost.

Bids must be submitted on proposal forms furnished by the Architect or copies thereof. All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Architect (Engineer); the bidder shall show such evidence by clearly displaying his or her current license number on the outside of the sealed envelope in which the proposal is delivered. A Mandatory Pre-Bid Conference Walk-Thru shall be held starting at Glencoe High School, 803 Lonesome Bend Road, Glencoe, Alabama, at 9:00 AM, Wednesday, October 20, 2021, then proceed to the other schools. All Bidders are encouraged to attend.

The projects shall be bid excluding taxes. Bids must be submitted on proposal forms furnished by the Architect or copies thereof. The Owner reserves the right to reject any or all proposals and to waive technical errors if, in the Owners judgment, the best interests of the Owner will thereby be promoted.

A certified check or Bid Bond payable to the Etowah County Schools in an amount not less than five percent (5%) of the amount of the bid, but in no event more than $10,000.00 must accompany the bidder’s proposal.  Performance and statutory labor and material payment bonds will be required at the signing of the Contract.

All bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Architect. All bidders shall show such evidence by clearly displaying current license number on the outside of sealed envelope in which the proposal is delivered.

Documents published thru this procedure are the only documents endorsed by the Architect. The Architect is unable to monitor, confirm and maintain other websites that provide documents. Addendums will be provided to entities that have CONFIRMED bidding for this particular project. The Architect retains ownership and copyrights of the documents. If bidders require printed sets, the following shall apply: Submit to the Architect at mckeeplans@gmail.com the company’s name, first & last name, phone number, address, project name & number along with a deposit of $150.00 per set. The deposit shall be refunded for each set returned in reusable condition within ten days after bid opening.
