ORDINANCE
NO. O-55-24
Amending City Code Chapter 2 – Administration
ARTICLE VI. – BOARDS, COMMITTEES, AND COMMISSIONS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:
Section 1. Chapter 2 Article VI of the Gadsden City Code is amended to add the following sec-tion:
Sec. 2-254. Arbor Board.
(a) Established. There is hereby created and established a board to be known as the Arbor Board.
(b) Membership. The Arbor board shall consist of 12 members to serve terms of three years each, with each term expiring on December 31. Seven appointments shall be made by the city council and five appointments by the mayor; all of which shall be approved by the council. If any vacancy occurs, it shall be filled by appointment by the mayor with approval by the council for the unexpired term. The members shall annually elect one of their members as chairperson and such other officers as they deem necessary. Members shall be residents of the city, employed by a business located within the city, or an owner of property within the city.
(c) Meetings. The board shall hold regular meetings at such time and place as it may from time to time determine. A thorough record of all meetings of the board shall be kept by the secretary. All meetings of the board shall be open to the public.
(d) Compensation of members. The members of the board shall serve without compensa-tion.
(e) Cooperation by other officials. Every board, department, employee and agency of the city is hereby authorized and directed to cooperate with the arbor board in promoting the or-derly and attractive operation of premises and facilities under city jurisdiction and in providing for the beautification of the city as a whole.
(f) Finances. The city council shall appropriate such funds which it may deem necessary for the reasonable expenses of the board. No such funds shall be expended without the prior ap-proval of the mayor.
(g) Powers. The arbor board shall have the following powers:
(1) Encourage the initiation and execution by governmental agencies, civic clubs and associations, merchants and property owners’ associations of programs to improve the arbor canopy and enhance the cleanliness and beautification of the city and its environs.
(2) Counsel with governmental agencies, private individuals, businesses and organizations regarding cleanliness and beautification of the city.
(3) Counsel with nurseries, garden shops, landscaping establishments, garden clubs and private developers on a voluntary basis to encourage a comprehensive, coordinated program for beautification of private and public premises within the city.
(4) Study and report from time to time on all such matters and perform such additional duties as the city council or mayor may direct.
(5) Assist an Arborist with projects in support of the City’s arbors and any portions of the City’s Strategic Plan relating to arbors and beautification
(6) Ensure annual renewal of the City’s Arbor City USA status by assisting in Arbor Day celebrations and completion of annual program paperwork
Section 2. The provisions of this ordinance shall be effective upon publication.
Section 3. The sections, subsections, paragraphs, sentences, clauses and phrases of this ordi-nance are severable. If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, para-graph, sentence, clause and phrase of this ordinance. The city council declares that it is its in-tent that it would have enacted this ordinance without such invalid or unconstitutional provi-sions.
Section 4. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.
