Said property is commonly known as 204 Keysburg Road, Gadsden, AL 35905.

Should a conflict arise between the property address and the legal description the legal description will control.

BE IT ORDAINED BY THE CITY COUNCIL OF GADSDEN, ALABAMA, that the Official Zoning Map of the City of Gadsden adopted by Ordinance No. O-02-82, as amended, is hereby further amended by changing the zoning classification district for the following described properties from R-2, Multiple-Family Residence District to O-1, Office District:

ORDINANCE NO. O-47-22

Amending Fiscal Year 2023 Budget

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, that Ordinance No. O-35-22 (Fiscal Year 2023 Budget) is further amended by transferring $407,753.00 from the general fund unassigned fund balance into account #001-9500-419.70-35 (Capital/System Software). The funds will be used to pay for the Amendment to the agreement with Tyler Technologies, Inc. authorized by Resolution No. R-342-22. Adopted by the City Council of Gads-den, Alabama at an open public meeting held on December 13, 2022.

ORDINANCENO. O-48-22

Amending City Code Sections 82-1 and 82-3

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALA-BAMA, as follows:

Section 1. Section 82-1 of the Code of Ordinances of the City of Gadsden is amended to read as follows:

Sec. 82-1. – Time and Place of Holding Court   

The municipal court shall hold court on each Tuesday and Thursday or at such other time and place as the City Council may determine.

Section 2. Section 82-2 of the Code of Ordinances of the City of Gadsden is amended to read as follows:

Sec. 82-3. – Compensation of Municipal Judges

(a) The compensation of a judge of the municipal court is hereby fixed at $1,000.00 per week for performance of lawful duties and responsibilities of municipal judge.

(b) In the event more than one judge presides over a weekly court session, the judges shall receive as compensation an appropriate proportional share of the compensation provided in paragraph (a) above.

(c) The total compensation for all judges shall not exceed $52,000.00 in any one fiscal year. It shall be the duty of the presiding judge to review the payment records each month and to assure that the yearly total does not exceed that amount.

(d) The clerk of the municipal court shall maintain a record of the sessions of court and hours worked by each judge every month, and shall submit a report to the finance department for payment of this compensation. She shall also provide to the presiding judge each month a report of the compensation paid to the judges for the preceding month and for the year to date.

(e) Any general increase in compensation after September 30, 2023, of all or substantially all municipal employees shall be applied proportionately to the hourly rate and to the maxi-mum total compensation for all municipal court judges. The finance department shall calculate the proportional increase and see that increase is paid to the judges.

Section 3. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent juris-diction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions

Section 4. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section5.  This ordinance shall become effective on December 13, 2022.
