NOTICE OF FORECLOSURE

Default having been made in the payment of the indebtedness secured by that certain mortgage dated September 07, 2007, executed by William Ray Avery and wife, Martha Avery to Mortgage Electronic Registration Systems, Inc., to CitiFinancial Corporation, LLC, which mort-gage was recorded on September 10, 2007, in Instrument Number 3278982, of the mortgage records in the Office of the Judge of Probate of Etowah County, Alabama which mortgage was duly transferred and assigned to Wilmington Savings Fund Society, FSB d/b/a Christiana Trust as Trustee for PNPMS Trust III, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Etowah County Courthouse at Gadsden, Alabama during the legal hours of sale on March 16, 2023, the following described real estate, situated in Etowah County, Alabama, to-wit:

ORDINANCE NO. O-07-23

Amending City Code Section 106-2. – Penalties.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN as follows:

Section 1. Section 106-2 of the Code of Ordinances of the City of Gadsden is amended to read as follows:

(a) All violations of the provisions of this chapter, except subsection 106-73(g), shall be punishable as follows:

(1) For the first offense, a fine up to $500.00 and a minimum of eight hours of community service collecting litter.

(2) For the second offence, committed within 12 months of the preceding violation, a fine up to $1,000.00 and a minimum of 16 hours of community service collecting litter.

(3) For the third offense, committed within 12 months of the preceding violation, a fine up to $1,000.00 and a minimum of three (3) days in jail.

(b) For purposes of this subdivision, any series of items found in the garbage, trash, or other discarded material including, but not limited to, bank statements, utility bills, bank card bills, and other financial documents, clearly bearing the name of a person shall constitute a rebuttal presumption that the person whose name appears on the material knowingly disposed of the litter. Advertising, marketing, and campaign materials and literature shall not be sufficient to constitute a rebuttal presumption of criminal littering under this subsection.

(1)No action under this litter control article based on evidence that creates a rebuttable presumption under subdivision (b) shall be brought against a person by or on behalf of the municipal governing body unless he or she has been given written notice by a designee of the governing body that items found in an accumulation of garbage, trash, or other discarded materials contain his or her name, and that, under subdivision (b), there is a rebuttable presumption that he or she knowingly deposited the litter. The notice shall advise the person that littering is a misdemeanor offense, and shall provide that, unless the person can present satisfactory information or evidence to rebut the presumption to the designee of the governing body within 15 days from the date of the notice, an action for littering may be filed against him or her in the appropriate court. If the person responds to the notice and presents information or evidence to the designee of the governing body, the designee shall review the information or evidence presented and make a determination as to whether or not an action should be brought against the person for littering. The designee shall provide written notice to the person of its determination, and if the intent is to proceed with an action for littering, the notice shall be sent before any action is filed.

(c) All violations of subsection 106-73(g) for failure to remove a garbage can shall first be provided a warning notice or citation; thereafter the minimum fine for the first violation shall be $25.00, and $50.00 for the second violation and $100.00 for the third violation within twelve (12) months of the preceding violation.

(d) The municipal court retains jurisdiction to assess the maximum fine and/or punishment as provided in Section 1-7 of this Code.

Section 2. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions.

Section 3. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 4.  This ordinance shall become effective on February 7, 2023.

ETOWAH COUNTY HAS BEEN AWARDED FEDERAL FUNDS MADE AVAILABLE THROUGH THE DEPARTMENT OF HOMELAND SECURITY (DHS)/FEDERAL EMERGENCY MANAGEMENT AGENCY UNDER THE EMERGENCY FOOD AND SHELTER NATIONAL BOARD PROGRAM.

Etowah County has been awarded $27,567 (considered Phase 40) to supplement existing emergency food and shelter programs in the county. The selection was made by a National Board that is chaired by the U. S. Department of Homeland Security’s Federal Emergency Management Agency and consists of representatives from American Red Cross; Catholic Charities, USA; National Council of the Churches of Christ in the USA; The Jewish Federations of North America; The Salvation Army; and, United Way Worldwide. The Local EFSP Board was charged to distribute funds appropriated by Congress to help expand the capacity of food and shelter programs in high-need areas around the country and will determine how these funds are to be distributed among the emergency food and shelter programs run by local service agencies in the area. Under the terms of the grant from the National Board, local agencies chosen to receive funds must:

1) be private, voluntary nonprofits or units of government,

2) be eligible to receive Federal funds,

3) have an accounting system,

4) practice nondiscrimination,

5) have demonstrated the capability to deliver emergency food and/or shelter programs, and

6) if they are a private voluntary organization, have a voluntary board. Qualifying agencies are urged to apply.
