A BILL TO BE ENTITLED AN ACT

STATE OF ALABAMA, COUNTY OF ETOWAH

NOTICE is hereby given that a bill substantially as follows will be introduced in the 2024 Regular Session of the Legislature of Alabama and application for its passage and enactment will be made:

Relating to Etowah County; to further provide for service of process; and to provide for the collection and dispensation of fees associated with service of process.

BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:

Section 1.

(a) The Sheriff of Etowah County may contract with a private, public, or governmental entity for the purpose of service of process for any document other than a warrant for arrest.

(b) In addition to all existing charges, fees, judgments, and costs of court, the clerk, sheriff, or other appropriate court official in district and circuit courts of Etowah County shall collect a service of process fee of thirty-five dollars ($35) per document which shall be paid into the Sheriff’s Law Enforcement Fund.

(c) The Sheriff of Etowah County may use the monies generated by this section at his or her discretion for any lawful purpose.

(d) The monies generated by this section shall not diminish or take the place of any other source of income for the sheriff.

Section 2.

This act shall become effective December 1, 2024, contingent upon the ratification of the amendment to the Constitution of Alabama of 2022, authorizing the Legislature to fix and regulate court costs in Etowah County by general or local law, and ratifying all previously collected court costs in Etowah County, as proposed in SB____ of the 2024 Regular Session.

The City of Gadsden will hold a Public Review Meeting to solicit comments on the Draft 2024 Annual Action Plan at the City of Gadsden, 90 Broad Street, Gadsden, AL 35901 in the Council Chamber at 5:00 P.M on Thursday, March 14, 2024.

The City is required to develop an Annual Action Plan which will include the annual allocation of funding by the City and is submitted to the U.S. Department of Housing & Urban Development as a prerequisite to receiving funds for the Community Development Block Grant Program. The City’s 2024 CDBG allocations have not been released by HUD. The City’s HUD funding recom-mendation are based on an estimated 70% of the CDBG funds allocated in 2023, which was $979,724.00. Proposed funding allocations for the City’s 2024 CDBG Program will be listed on the City’s website at

https://www.cityofgadsden.com/160/Community-Development.

Draft copies of the 2024 Annual Action Plan will be available for examination and comment by the public via the City’s website at https://www.cityofgadsden.com/160/Community-Development. The City will receive written comments until 5:00 P.M. on Monday, April 1, 2024.

ORDINANCE  NO. O-13-24

Gadsden Emergency Communication District Creation and Territory

Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA as follows:

Pursuant to section 11-98-1 et seq., Code of Alabama, there is now created the Gadsden Emergency Communication District (GECD), from now on referred to as “district,” which district shall encompass all of the territory lying within the corporate limits of the city.

Same, the Board of Commissioners Established 911 Services Provided For

A board of commissioners shall govern the Gadsden Emergency Communication District. The board shall consist of seven (7) members who shall be qualified electors of the City, nominated by the Mayor and appointed by the City Council, as follows:

A certified law enforcement officer

A certified professional firefighter

A City of Gadsden employee who is knowledgeable of matters relating to emergency communications, emergency management, or first responder services

A member of the Gadsden City Council

An administrative professional (director or department head) employed by the City of Gadsden

A member who is not a City employee and is knowledgeable of matters relating to emergency communications, emergency management, or first responder services

A member who is not a City employee whose appointment shall support diversity in the demographic, geographic, and experiential makeup of the board

Each member shall serve until such time that a successor has been appointed and qualified or until such time the member is no longer otherwise qualified. The first slate of board members shall serve as follows: two for terms of two years, three for terms of three years, and two for terms of four years. After that, all appointments shall be for terms of four years. If other governmental entities in the county elect to become subscribers to the 911 emergency service, the geographical boundaries, the designation, and the constituency of the governing body of the emergency communication district will be appropriately changed.

Same, the Duties of the Board.

The board of commissioners shall:

Have the authority and powers necessary to establish, operate, maintain, and replace an                                      emergency communications system.

Appoint a president and any other officers it may deem necessary from the board’s membership;

Employ such employees, experts, and consultants as it deems necessary to assist in carrying out the board’s responsibilities;

Negotiate and execute contracts as required in the discharge of the board’s responsibilities;

Maintain custody of money collected and invest as appropriate to enhance funding of the communications district;

(6) Levy on all of the telephone subscribers within the district an emergency telephone service charge not to exceed five (5) percent of the local service tariff rates charged to these subscribers by a service supplier servicing the district.

(7) Obtain the personnel, lines, and equipment necessary to upgrade the basic 911 emergency service to provide enhanced emergency service of E-911 Service, as defined in the Act.

(8) Collect from local telephone companies or service suppliers every quarter the amount collected by these companies attributable to the emergency telephone service charge to the telephone subscribers within the district;

(9) Disburse funds collected from the emergency telephone service charge or any other sources in the discharge of its responsibility under law;

(10) Where the revenue set out in (1) above proves to be more than the amounts needed to operate the service, the governing body shall reduce the subscribers’ levy accordingly;

(11) Charge, bill, and contract with all public agencies, emergency communication districts, municipalities, and other political subdivisions of the State of Alabama for use of equipment, facilities, or administration related to the operation of the 911 system;

(12) Do all other things as prescribed by the Act for implementing and servicing the district with enhanced 911 emergency service.
