Authorizing Conveyance of Certain Property
Whereas, the City of Gadsden owns the following described property;
Commencing at the Northwest corner of the Northeast 1/4 of the Southeast 1/4 of Section 23, Township 12 South, Range 6 East in Etowah, County, Alabama; thence run South 78°21’43” East for a distance of 40.66 feet; thence run South 36°14’14” West for a distance of 6.31 feet to an iron pin found (1/2” rebar with cap stamped JBW&T, Inc. CA0046LS); marking the Northeast corner of Lot 1, Block 6, Second Addition to Paden Farms as recorded in Plat Book C, Page 275 and the South right-of-way line of Riverside Drive, thence run North 89°12’14” East along said right-of-way line for a distance of 74.17 feet to a point on the said right-of-way line; thence run North 89°26’18” East along said right-of-way line a distance of 44.20 feet to a point on the South right-of-way line of College Parkway also being the point of beginning; thence leaving said right-of-way line run North 02°13’29” East a distance of 35.26’ to a point; thence run North 56°43’47” East a distance of 62.79 feet; thence run South 87°51’32” East a distance of 282.67 feet; thence run South 52°59’54” East a distance of 34.27 feet; thence run South 27°51’32” East a distance of 39.31 feet to a 1” pinch top pipe on the South right-of-way line of College Parkway; thence run South 89°26’18” West a distance of 382.09 feet to the point of beginning.

Whereas, the City desires to donate the above real property to Koch Foods of Gadsden, LLC, in order to construct an additional parking area to accommodate the plant expansion and economic development.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:
- This real property is not needed for any municipal or public purpose.
- The Mayor is hereby authorized and directed to execute a Warranty Deed to Koch Foods of Gadsden, LLC, and to do all things necessary to carry out the terms of the conveyance.
