Default having been made of the terms of the loan documents secured by that certain mortgage executed by Leann Nichols A Married Woman  to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Success Mortgage Partners, Inc., its successors and assigns dated August 19, 2020; said mortgage being recorded on August 21, 2020, as Instrument No. 3507142 in the Office of the Judge of Probate of Etowah County, Alabama. ORDINANCE  NO. O-27-22

Accepting Offer by Landmark Ventures, Inc. for the Property Located at 500 Grady Street and Conveying Said Property to Landmark Ventures, Inc.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Property located at 500 Grady Street was constructed in 2005 under the CDBG affordable housing reconstruction program, and was sold to a qualified low-moderate income homeowner.

Section 2. Homeowner defaulted on the CDBG mortgage, and foreclosure procedures were taken.  Property was offered  at a foreclosure auction where no bids were received.  The City has no further need of said property.

Section 3. CDBG property should remain as affordable housing.  All proceeds from conveyance of said property are considered program income under the CDBG program per HUD regulations, and shall be receipted back into the CDBG program.

Section 4. Landmark Ventures, Inc. (501C3 under the Greater Gadsden Housing Authority) has offered $45,000 for the property as affordable housing through its Housing Choice Voucher Program (aka Section 8 Program).

Section 5. Accept and convey said property to Landmark Ventures, Inc., and authorize the Mayor to sign conveyance documents on behalf of the City.

The Contract Documents may be examined at the Attalla City Hall or copies of the Contract Documents may be obtained from The City of Attalla Engineering Department (256) 538-9986.

The Owner reserves the right to waive any informalities or to reject any or all bids, and to award the contract to the best and most responsible bidder.  All bidders must comply with requirements of the Contractor’s Licensing Law of the State of Alabama and be certified for the type of work on which the proposal is submitted.  Each bidder must deposit with his bid, security in the amount, form and subject to the conditions provided in the Instruction to Bidders.

All Bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Engineer; the Bidder shall show such evidence by clearly displaying the license number on the outside of the envelope in which the Proposal is delivered.

No bidder may withdraw his bid within 60 days after the actual date of the opening thereof.

Be it known that Steve and Cynthia Campbell being the owners of property abutting Marie Drive hereby request the Etowah County Commission to vacate a portion of said road described as follows:

A portion of right-of-way known as Marie Drive lying in the Northwest ¼ of the Southwest ¼ of Section 35, T-10-S, R-7-E and shown on the Etowah County tax map as being 60’ in width lying 30’ left and right of a centerline, including a cul-de-sac being further described as follows:

Commence at the point where the north line of the NE of the SE intersects the northwesterly line of U. S. Highway No. 411; thence run South 29° 25’ 59” West along said northwesterly line a distance of 490.23 feet to a point being the centerline of a right-of-way sixty (60) feet wide public road known as Marie Drive as recorded in Deed Book 1685, Page 138 in the Office of the Judge of Probate of Etowah County, Alabama; thence deflect 89° 48’ 56” right and run a distance of 90.54 feet to the P. C. of a 32° 58” 13” degree curve to the left; thence run a distance of 115.54 feet along said curve to the left to the P. T. thereof; thence continue along said right-of-way center line to a point of intersection with the northwesterly right-of-way line of  Project No. STPAA-137(12) of record with the Alabama Department of Transportation, a copy of which is also deposited in the Office of the Judge of Probate of Etowah County, Alabama, said point being the Point of Beginning.  From said Point of Beginning continue along said course to a point in the center line of a cul-de-sac having a radius of fifty (50) feet, and end of right-of-way.

This matter will be considered at the 8-2-2022 Etowah County Commission meeting at 9:00 am at the Etowah County Commission Office, 800 Forrest Avenue, Gadsden, Alabama 35901.
