Default having been made in the payment of the indebtedness secured by that certain mortgage executed by James T. Greer and Sherry W. Greer, joint tenants with rights of survivorship, to Mortgage Electronic Registration Systems, Inc., as Mortgagee, as nominee for Matrix Financial Services Corporation, its successors and assigns, on June 25, 2003, said mortgage being recorded in the Office of the Judge of Probate of Etowah County, Alabama, on July 8, 2003, as Document Number M-2003-3370. Authorizing Conveyance of Certain Property

Whereas the City of Gadsden owns property located on North 6th Street, more particularly de-scribed as follows:

ORDINANCE NO. O-57-23

Amending City Code Section 46-97(b)(4)

Whereas, the current Ordinance prohibits commercial deliveries adjacent to residential areas from 9 p.m. to 7 a.m.; and

Whereas, Wal-Mart store #310 seeks an amendment to the City’s noise ordinance to allow deliveries from 4:00 a.m. to 10:00 p.m. because it requires more deliveries since COVID, due to customers ordering on-line for store pickup; and

Whereas, a noise study was conducted to determine the noise impact, if any, on the adjacent residential units. As determined by its study, the impact of noise caused by deliveries to the store on adjacent residential units would not exceed 70 decibels. 70 decibels is equivalent to office noise or noise inside a motor vehicle traveling at 60 mph; 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GADSDEN, ALABAMA, as follows:

Section 1. Section 46-97(b)(4) of the Code of Ordinances of the City of Gadsden is amended to read as follows:

(4) Loading, unloading and delivery activities. Loading, unloading, delivery, opening, closing or other handling of boxes, crates, containers, supplies, foodstuffs, building materials, garbage cans, or similar objects between the hours of 9:00 p.m. and 7:00 a.m. the following day across a residential real property boundary, within a noise sensitive zone or within a residential area. This includes all forms of delivery, whether delivered by the distributors, agents, dealers, stores or consumers, by their own vehicles, by hired trucks, by common carriers or by other means, including time while waiting to load, unload, deliver, open, close or handle, and sounds or signals (including flashing lights) involved in backing up of such vehicles.

(a) Should any loading, unloading or deliveries occur before or after the above prescribed time, such activity may not exceed 70 decibels as read by a sound level meter at any point that is normally occupied as a residence.

Section 3. The section, subsections, paragraphs, sentences, clauses and phrases of this ordinance are severable.  If any section, subsection, paragraph, sentence, clause and phrase of this ordinance is declared unconstitutional or invalid by a valid judgment of a court of competent jurisdiction, such judgment shall not affect the validity of any other section, subsection, paragraph, sentence, clause and phrase of this ordinance.  The city council declares that it is its intent that it would have enacted this ordinance without such invalid or unconstitutional provisions. 

Section 4. The provisions of this ordinance repeal any prior ordinance or provision of the Gadsden City Code to the extent of any conflict.

Section 5.  This ordinance shall become effective on August 29, 2023. Adopted this ordinance at an open public meeting held on August 29, 2023.

By signing this contract, the contracting parties affirm, for the duration of the agreement, that they will not violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the state of Alabama. Furthermore, a contracting party found to be in violation of this provision shall be deemed in breach of the agreement and shall be responsible for all damages resulting therefrom.

Bidders must certify that they do not and will not maintain or provide for their employees any facilities that are segregated on a basis of race creed, color, sex, or national origin.  Bidders must also certify they will make facilities handicap accessible to the extent required by law.

NORTHEAST ALABAMA REGIONAL MEGA-SITE WATER TRANSMISSION MAIN

Sealed bids for the Northeast Alabama Regional Mega-Site Water Transmission Main Project will be received at the Etowah County Commission Chambers (Room 108), located on the First Floor of the Courthouse, 800 Forrest Avenue, Gadsden, AL 35901 until Wednesday, September 27, 2023 at 10:00 A.M. local time at which time the Bids received will be publicly opened and read.

The Project includes the following Work:  Installation of approx. 19,000 linear feet of 16” water transmission mains and related appurtenances.

All Bidders bidding in amounts exceeding that established by the State Licensing Board for General Contractors must be licensed under the provisions of Title 34, Chapter 8, Code of Alabama, 1975, and must show evidence of license before bidding or bid will not be received or considered by the Engineer; the Bidder shall show such evidence by clearly displaying the license number on the outside of the envelope in which the Proposal is delivered.
